Goodrich - Ramsey City Attorney <br />Plants & Things <br />June 3, 1986 <br /> <br /> At your joint meeting on May 13, 1986, a discussion was held <br />concerning certain building and/or zoning violations which Plants <br />& Things may have committed by its recent construction of a <br />building on its site. I would like to comment on each of these <br />issues: <br /> <br />1. Zoning <br /> <br />The subject property is located in the City's B-1 Business <br />District which has as a permitted use Retail Business, <br />therefore, the present use is consistent with the property's <br />zoning. <br /> <br />2. Setback <br /> <br />Section 170.014L of the City code requires a building setback <br />of 110 feet from the center line of a thoroughfare street <br />and/or 50 feet from the right-of-way of such a street. The <br />newest building on the site is 46 feet and 49 feet <br />respectively from the street right-of-way. <br /> <br />3. Off-Street Parking <br /> <br />Section 170.014C of the City code requires one space for each <br />200 square feet of retail floor space. In addition, this <br />section requires that the off-street parking be graded for <br />proper drainage and surfaced as to provide a durable and <br />dustless surface. To date, the City has not received a <br />parking plan from the owner. <br /> <br />4. Off-Street Loading <br /> <br />Section 170.014D of the City code requires one berth of not <br />less than 50 square feet for each 10,000 square feet of floor <br />area. The existing operation is close to 10,000 square feet <br /> <br /> <br />
