Loading: An off-street loading facility shall be provided with an area of not less than twelve feet in width and sixty- feet on length, exclusive of aisles and maneuvering space. Such facility shall be at the rear of the principal struc- ture and shall be used exclusively for the lo&ding and loading of ~erchandise. All such facilitles, alsles and maneuvering space shall be sur£aced in the same manner as that prescribed for parking areas. Compliance: In order to assure compliance with the performance standards set forth above, the City Council may require the owner or operator of any permitted use to make such investigations and tests as may be required to show adherence to above per- £ormance standards. Such investigation and tests as are required to be sade shall be carried out by an independent test/nE organization as may be agreed upon by the City and the owner or operator, or if there is failure to agree within ten days after written notice by the City to the owner or operator to make such invest/- gation and tests, by such independent testing organiza- tion as may be selected by the Council. Yhe Costs in- curred in having such investigations or tests conducted shall be borne entirely by the owner or operator. The procedure stated above shall not preclude the City from taking any such other tests and investigations it finds appropriate to determine compliance with these performance standards. All costs incurred by the City in processing an application for a site plan review shall be paid by the applicant. Said costs shall include but not be limited to: professional consulting services as directed by the Planning Commission and/or City Council, copying charges, extraordinary City staff involvement, public hearing publications, and written notice to adjacent property owners. A set fee established from time to time by the City Council shall be deposited with the City at the time the application is made. At the time the application is made, if the Zoning Officer determines that costs in addition to the set fee will likely be incurred by the City, then an additional sum as determined by the Zoning Officer shall be deposited with the City. Any portion of those funds deposited but not expended shall be returned to the applicant after final action on the application.
