Absent: Commissioners Shumwsy <br />and 8endriksen. <br /> <br />Discussion Regardin~ Plan~s And Things: <br /> <br />Commissioner Deemer referred to page 16 of July 22, 1986 Council minutes and <br />noted that City Council reversed Planning and Zoning action in the case of <br />Plants and Things; Councilmember Cox aimed comments at Commissioner Deemer in <br />particular. Commissioner Deemer stated that on Hatch 19, 1986 there vas a <br />special Planning and Zoning meeting (which happens to be the day construction <br />of tbs new building began at Plants and Things), at which time he brought it to <br />the attention of the P&Z and City Staff that the building was not up to code. <br />For various reasons, construction of the building vas never stopped. <br />Commissioner Deemer stated that Hr. Bickman relied upon pacing by the building <br />inspector to determine that setbacks were met and the problems multiplied from <br />that point on. Commissioner Dee~er stated that he attempted to contact the <br />Mayor and could not get in touch with the City Attorney until it vas too late <br />to stop construction. Commissioner Deemer stated that he did talk to former <br />· uilding Inspector Clayton ~erg and Hr. ~erg claims that Mr. Hickman first <br />applied for a building permit when he vas still on staff at Ramsay; he told <br />Hickman that a certified site plan vas required. Therefore, Hr. Bickman did <br />know what vas required but took advantage of a loop hole and erratic conditions <br />at City Hall. Commissioner Deemer noted that on July 22, 1986, Councilmember <br />Cox abstained from voting on an issue because of a personal disagreement with <br />one of the participants in the case. On Chat basis, Councilmember Cox should <br />not vote on issues that have participants with which he has a personal <br />agreemeentl maybe Hr. Cox should not be on Council if he can't separate <br />personal issues from business. Commissioner Deemer stated that he resents <br />Councilmember Cox' inference that he is 'picking on Hr. Bickman'. <br /> <br />Ha. ~orris stated that she and Councilmember Cox have met with Hr. Hiclunan <br />regarding items of concern listed in City Attorney ~e~o dated June 3, 1986. <br />Hr. Hickman agreed to surface parking lot and driveways on his own time line; <br />to appropriately ~ark parking areas, improve exterior appearance of new <br />structure and provide a non-certified site plan. <br /> <br />Hotiou by Chairman Peterson and seconded by Commissioner Hovel1 to recommeud <br />that Mr. Larry ~ickman be required to fulfill the certified site plan <br />requirement, just as any other person in ILsnsey is required to do; and that if <br />any variances from that site plan requirement are granted, the reasons for <br />doing so be spelled out in motion form. <br /> <br />Further Discussion: Chairman Peterson stated that information gained from the <br />certified site plan (lot dimensions, building size and location) determine the <br />amount of parking area that will be required; reasons for waiving that <br />requirement should be public record. <br /> <br />Amendment by Commissioner LaDue and seconded by Commissioner Zimmerman <br />acknowledging that Commissioner Deemer vas not acting independently beyond his <br />authority as a member of the Planning and Zoning Commission; that Commissioner <br /> August 5, 1986 <br /> <br /> <br />
