Councilmember Cox stated that the city encourages business growth to improve <br />employment opportunities and tax base; Mr. Root is wasting time and money by <br />not accomplishing what he agreed to in the permit agreement. If Council action <br />is to direct findings of fact be prepared to revoke Mr. Root's permit, <br />hopefully, Mr. Root will be in compliance by the time those findings are <br />presented to council for action and consideration can be given to not revoking <br />the permit. <br /> <br />Councilmember DeLuca noted that the proposed findings of fact state that on <br />July 23, 1986 Mr. Root agreed to get into compliance within one month; photos <br />reveal that has not happened. Councilmember DeLuca stated that he would be in <br />favor of a 2-4 week extension and if at that time nothing has happended, there <br />will be no further discussion and action will be taken to revoke the permit. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember Sorteberg to direct <br />City Staff to schedule the case of Mr. Gerald Root's conditional use permit on <br />the regular October Council meeting agenda, at which time Staff will have <br />available for review and action findings of fact to revoke the permit. <br /> <br />Further Discussion: Councilmember Cox requested that Mr. Ylitalo express to <br />Mr. Root Council's desire for Mr. Root's business to continue but that based on <br />the conditional use permit agreement, Council is compelled to require <br />compliance with the agreement within reason. Mr. Hartley suggested that either <br />Mr. Root or his representative may also provide input to the findings of fact <br />by October 15. Mr. Goodrich stated that Mr. Root or his representative may <br />also offer testimony at the October Council meeting and Council should accept <br />that testimony. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Schlueter, Cox, <br />Sorteberg and DeLuca. <br /> <br />Request For Preliminary Plat Approval.Of Stanhope River Hills: <br /> Case Of Ms. Ann Canis And Mr. Tom Skiba: <br /> <br />Ms. Canis and Mr. Skiba were present. <br /> <br />Ms. Norris stated that Ms. Canis and Mr. Skiba are present requesting <br />preliminary plat approval of Stanhope River Hills which is approximately 66 <br />acres in size and consists of 18 single family residential lots. The Planning <br />Commission is recommending preliminary approval; Park Commission is <br />recommending acquiring the outlo~ in the southeast corner for future park <br />development. The plat is located in the Scenic Rivers Overlay District and <br />meets the requirements of DNR. <br /> <br />Councilmember Cox inquired as to what is proposed for surfacing Roanoke. <br /> <br />Mr. Raatikka replied that it is a MSA road and improvements to it would be <br />funded with State aid funds; it should be surfaced in 1987. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember Sorteberg granting <br />preliminary plat approval to Stanhope River Hills. <br /> <br />September 30, 1986 <br /> <br />Page 6 of 16 <br /> <br /> <br />
