!
I
I
I
I
,I
I
I
I

the City wants addressed on future permits; and with this proposed agreement
with Mr. Bud Sauter, the City would be establishing such a policy. Mr.
Goodrich noted that the bonding amount on permits can vary.

Councilmmber Cox referred to Mr. Sauter's ~mm~nt regarding going for a
grading permit through the platting process and suggested that Mr. Sauter
explore all aspects and ramifications before making a decision to do so.

Mr. Berg stated that the City does not have an ordinanoe oontrolling mining;
oontrol is through Chapter 70 of the Uniform Building Oode - 'Excavating and
Grading'. Mr. Berg also stated that the word 'mining' is a misuse of terms.

Mr. Goodrich pointed out that all grading pemits, whether they are obtained
through the platting process or grading permit application process, require an
agreement and bonding.

Mr. Berg stated that some of the exceptions to requiring a grading and
excavating permit listed in the Building Code are as follows: excavations for
buildings, c~eteries, refuse disposal sites, wells or tunnel, cuts or fill
less than 2 feet.

Council oonsensus is to strike the term 'mining' from the agreement and
substitute it with 'excavating and grading'.

Mayor Heitman inquired if Mr. Sauter has a phasing and restoration plan.

Mr. Sauter stated that a plan was suk~itted to Planning and Zoning.

Mr. Raatikka stated that the plan does not show phasing or sequence in which
site will be graded and restored.

Mr. Sauter stated that he does not agree with Item S5 in the proposed
agreement; replacing of topsoil is necessary for his operation to proceed and
doesn't understand why it would be necessary for the City to inspect each
tract before he progresses onto the next.

Mr. Berg stated that a tract does not have to be 100% complete, but the City
should have the right to make sure that a good percentage of the restoration
is oomplete before Mr. Sauter moves onto the next tract.

Mr. Raatikka noted that Mr. Sauter will be working on two tracts (10 acres)
simultaneously, stripping from one and applying the fill to another.

Council consensus is to amend Item %5 of the proposed agreement restricting
the grading operation to not more than 10 acres at one time without
restoration having been accomplished and to notify City Staff acoordingly.

Mr. Sauter referred to Itm %6 of the proposed agreement and stated that a
$5,000 performance bond should be sufficient.

Council consensus is to amend Item %6 of the proposed agreement to set the
performance bond amount at $7,500.

May 14, 1985
