I <br /> <br />I <br /> <br />I <br /> <br />Councilm~mbez (]ox referred to Item ~10 of the proposed agreement and inquired <br />if Mr. Sauter would be hauling any dirt off the site and onto Ramsey roads to <br />take elsewhere. <br /> <br />Mr. Sauter replied that he would be hauling dirt off the site. <br /> <br />Mayor Heitman referred to Item %12 in the proposed agreement and the $1,000 <br />cash bond required. <br /> <br />Mr. Berg replied that the $1,000 is to oover administrative items over and <br />above those not included in the permit fee; at project oompletion, any unused <br />portion of that money is returned to the applicant. <br /> <br />Mr. Sauter requested that he be provided with an itemized statement regarding <br />the spending of that $1,000. <br /> <br />Motion by Councilmember (]ox and seconded by Councilmsmber Sorteberg to adopt <br />Findings of Fact 0103 regarding Mr. Bud Sauter's request for a oonditional use <br />permit agre~nent for excavating and grading. (Please refer to findings of <br />fact file for Findings of Fact 0103 ). <br /> <br />Further Discussion: Mr. Sauter's son referred to Ite~ #2 in the proposed <br />agreement which restricts work to not within 500 feet of the north boundary <br />until the buffer area has been established; work already in progress is within <br />200' of the north boundary. Mr. Sauter stated that s~me trees have been <br />planted in the buffer area. Oouncil consensus is to amend Item %2 of the <br />proposed agreement to restrict work to not within 200' of the northern <br />boundary until the buffer area is established. <br /> <br />Motion carried. Voting Yes: Mayor Heitman, Gouncilma~bers Sorteberg, Cox, <br />Reimann and Schlueter. Voting No: None. <br /> <br />Motion by Councilm~aber Cox and seconded by Mayor Heitman to approve Mr. Bud <br />Sauter's request for a Gonditional use permit for grading and mining, <br />contingent upon Mr. Sauter entering into a grading and excavating agreement, <br />as modified, with the City. Those modifications are as follows: <br /> <br />1. Strike all references in the agre~aent to 'mining' and substitute <br /> with ' grading and excavating'. <br /> <br />Amend It~ ~5 of the proposed agreement to limit the grading and <br />excavating process to not more than 10 acres at one time without <br />restoration having been acoomplished and City Staff having been <br />notified accordingly. <br /> <br />3. Amend Item ~6 to set the performance bond amount at $7,500. <br /> <br />e <br /> <br />Amend It~ #2 of the proposed agreement to restrict operations to <br />not within 200' of the northern boundary until the buffer area has <br />been established. <br /> <br />Motion carried.
