Consideration Of 167th Avenue N~: <br /> <br />City Engineer Raatikka stated that he _b~ reviewed the feasibility of upgrading <br />167th Avenue N~ west of Nowthen Blvd. ~W and noted that because the City's <br />share is more than 20% of the project cost, the C~arter allows the opportunity <br />for 50% of the voters in the last election to petition to cease project <br />consideration. <br /> <br />Motion by Mayor Heitman and seconded by O~uncilmember Sorteberg to table <br />further consideration of this case until the regular Council meeting scheduled <br />for June 25, 1985 to allow City Attorney Goodrich and Councllmember Cox time to <br />contact the Hunt family in order to determine whether or not they are inclined <br />to petition against the project. <br /> <br />Motion carried. Voting Yes: Mayor Heitman, Councilm~bers Sorteberg, Cox, <br />Reimann and Schlueter. Voting No: None. <br /> <br />A. Adoption Of Proposed Environmental Protection Ordinance <br /> <br />Councilmember Schlueter stated that she is opposed to the proposed ordinance, <br />specifically Page 1, Item 170.01122% (b), 3rd Sentence - based on the fact that <br />she orignally agreed with reclassification of Sunfish Lake, but after further <br />discussions with previous Councilm~mber Sue Van Wagner, she desired to rescind <br />her decision on reclassification of Sunfish Lake. Councilmember Schlueter <br />stated that she doesn't recall being able to be involved in not reclassify <br />Sunfish Lake. <br /> <br />Mr. Raatikka stated that a public hearing was held in February, prior to the <br />ordinance ~o~ing to Council and ~ot comments were made at the public hearing. <br /> <br />Gouncilm~r Schlueter stated that if Oouncil is going to adopt this ordinance <br />tonight, she would hope that it is going to be enforced; there is clear <br />cutting, loss of water, etc. happening now that is not being dealth with <br />properly; Mr. Kurak clear cutted his back yard. <br /> <br />Mr. Schnelle stated that the City cannot enforce an ordinance unless there is <br />an ordinance. <br /> <br />Gouncilm~r Schlueter stated that the City did a good job of enforcing with <br />Mr. Potter. <br /> <br />Mr. Schnelle stated that Mr. Potter's property falls under Wild and Scenic <br />River Ordinance jurisdiction. <br /> <br />Motion by Councilms~ber $orteberg and seconded by Mayor Heitman to dispense <br />with the reading of proposed Ordinance %85-2 entitled the Enviror~ental <br />Protection Ordinance. <br /> <br />Motion failed. (Motion to dispense with the reading of an ordinance must be by <br />a unanimous vote in order to carry.)
