City Attorney Goodrich replied that the moratori~ has not been lifted and no action needs to be taken by City Council at this time; Oouncil can wait until Waste Management of Minnesota sutmits a request for grading and excavating after the moratori~ is lifted to address the issue. Oouncilmsnber Cox stated that he is interested in getting that moratori~ lifted; he would like to see some provision that Ramsey has taken action to lift that moratori~ to avoid expansion of Site P and encouraged the proper closing of this landfill site as soon as possible. Mr. Don Otter was present and stated that Waste Manag~nent of Minnesota will be submitting an application to the County very soon regarding the lifting of the mot ator ium. Mr. Goodrich stated that the City can provide input regarding the lifting of the moratori~ when the issue comes before the County Board. Councilmember Cox inquired as to why the Council can't take action this evening based on the Landfill (k~mittee's recommendation. Councilm~ber Gox stated that if it were a case of develolm~-nt wishing to occur in the moratorium area that would provide additional tax base to the o~ty, would the City support that development's efforts or would the City have that develolm~ent pursue the liftin9 of the moratori~ on it's own. Motion by Councilm~mber Gox to grant a grading and excavating permit to Waste Management of Minnesota, Inc. based on the following: 1. To avoid playing any part in supporting the expansion of Site P. 2. To have the moratorium ceased. A grading and excavating permit was recently granted to Mr. Walton Sauter and Waste Management of Minnesota's request should be granted on the same basis. FUrther, that Metro Council and Anoka County have enoouraged the selection of Site P by imposing the moratori~n and Ramsey's action should be to make every effort possible to see that certain areas of the landfill are properly covered to insure better future use of the area for industrial/co~ercial development. Further, that this motion to grant the grading and excavating permit to Waste Management of Minnesota, Inc. is not contingent upon the Metro Council and Anoka County lifting the develolm~.nt moratorium. Councilm~mber Reimann seconded the motion for discussion. FUrther Discussion: Councilmember Reimann inquired if there is anything wrong with Councilmember Gox's motion. Mayor ~eitman stated that there is nothing wrong with the motion other than the fact that it is inappropriate until Metro May 28, 1985 Page 29 of 31
