situation. <br /> <br />Mayor Heitman inquired as to the City's liability if there would be an accident <br />at the urossing during the developer's marketing of property. <br /> <br />I <br />I <br />I <br />I <br /> <br />Mr. Goodrich stated that the City can include a liability disclaimor in the <br />develolmmnt agreement. <br /> <br />Council consensus is that a liability disclaimor be included in the develolm~nt <br />agr e~m~nt. <br /> <br />Motion by Councilmember COx and seconded by Councilmember Reimann to adopt <br />Findings of Fact o~o? regarding the Northfork Planned Unit Development, ~uended <br />as follows: (Please refer to findings of fact file for Findings of Fact ~,o7.) <br /> <br />All references to West Oaks Planned Unit Development will be changed <br />to Northfork Planned Unit Development; oorporation will be named North <br />Fork, Inc. <br /> <br />I <br />I <br />! <br />! <br />I <br /> <br />Motion carried. Voting Yes: Mayor Heitman, Gouncilmembers Sorteberg, Cox, <br />Reimann and Schlueter. Voting No: None. <br /> <br />Council unanimo~y consented to dispense with the reading of the resolution. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember Sort. berg to adopt <br />Resolution #85-110 granting preliminary and final approval of Northfork <br />Planned Unit Development contingent upon the developer enterin~ into a <br />development agreement with the City.
