Councilmenber Cox stated that Mr. Auel has been here since 1982 and has had a reasonable mount of time to make arrangements for p~rking his equipment in other than an R-1 district. Mr. Goodrich stated that the Council can direct the City Attorney's office to prosecute to make sure the ordinance is oomplied with or Mr. Auel can apply for a conditional use permit. If that permit is granted, Mr. Auel will be legitimate; if it is not granted, enforce the ordinance. Mr. Auel stated that there are lots of violations of the ordinance right in his neighborhood. Mr. Goodrich stated that the City cannot selectively prosecute; everyone must be made to oc~ply and be treated equally. Motion by Mayor Heitman and seconded by Councilmenber Schlueter directing that the Zoning Ordinance be placed on the Gouncil agenda for August 13 for Council review and discussion. Further Discussion: Mr. Auel stated that there is a mix of blue and white collar workers in Ramsey and there will always be a conflict. Motion carried. Voting Yes: Mayor Heiman, Councilm~nbers Sorteberg, Cox, Reimann and Schlueter. Voting No: None. Case %~ Drainage Problems And Other Effects Of High water Table: Councilmenber Reimann stated that per the June 25 agenda, it was suggested that $2500 be appropriated for installing testing wells in Flintwood II and River Acres. Councilme~ber Reimann suggested that the money be used to test private wells in those area. Mr. Berg stated that the probl~n is not with residential wells, it is with the upper ground water which feeds into the lower reaches; that upper ground water should be tested for contamination. Motion by Councilmenber Reimann and seconded by Mayor Heitman, for discussion, to authorize the testing of ground water in the Flint-wood Hills Seoond Addition area and Barthel Rm River Acres. Further to authorize costs not to exceed $2,500 which will allow for approximately four test wells. Further Discussion: Councilmmber Gox inquired as to the City's course of action when the information is received; the p~ivate wells should be tested first and if there is contamination, proceed to the more costly action of installing monitor wells. Councilmember COx noted that the ground water may be contaminated as a result of it being a concentrated area and fr~n l~n fertilizer run-off. Mr. Berg stated that if there is contamination, municipal services would have to he installed to correct the situation. A negative findings on the testing would show the citizens that they better pay close attention to their own wells and have then tested more often than they normally would. July 9, 1985 Page 15 of 22
