I
process. 'l~e legal, advice to the Ootmty was that. if the request, were to be
I ~nied, it would give Waste Managepent a oouple of recourses: 1. ~ey would
be entitled to pursue several hundred thousand dollars in _~._pensation~ 2. ~hey
could take the Gounty to court and it would be the O~m~ty because the Oo~ty
I would be denying the lifting of develolm~-nt limitations as Metro Oouncil cannot
cwerrule the Oounty and Waste Management would win. ~e Oounty did vote to
a/low Waste Management to mine 247,000 cubic yards of subject to Waste
I Managem~_nt getting Ramsey's approval for neoessary permits. G~mmissioner Haas
stated that in defense of h~r vote today, she doesn't think taking somebody to
court is a very wise expenditure of tax dollars if there is legal advioe saying
'it's no use'. (bunty Go~nissio~er Haas stated that nobody from Ramsey was
I present at a Metro Gouncil meeting after she had specifically requested that
Metro Oomcil invite Ra~sey. At that meeting, Waste Management of Minnesota,
Inc. talked about d~anging the contours of the landfill with 1.2 million
I cubic yards of trash; the City of Ramsey and Comty ~issioner Haas' office
will be receiving a large mount of information addressing re~al action.

I
I
I
I
I

Mr. Schnelie inquired as to why the Gounty doesn't assist Ramsey in it's
Proposed legislation action to protect hosting cities. Ramsey is a very busy
city and there is no way we can make it to all these meetings.

Gouty (lm~issioner Haas stated that the Gounty would look at that proposed
legislation and support Ramsey; added that she is not here to chastise Ramsey
for not attending the meetings.

Mayor Heitman inquired if the Gounty's approval of lifting the develot~ent
limitations was subject to Ramsey's approval.

O~ty (k~missioner Haas stated that it was not; the lifting of the develolm~.nt
limitations was the Gomty's responsibility but Ramsey might have certain
permits and requir~ents in regards to mining; on~ of the oonditions of the
Oo~ty's approval was that Waste Management obtain the necessary licenses or
permits Ramsey may require.

I
I
I

Oouncilmember (Dx stated that the July 29 O~uncil minutes show that Mr.
Schr~le made it known that the Enviror~ental Services (k~mittee was having a
meeting and this Gouncil directed City Staff make it known that Ramsey doesn't
want any goverm~ent body doing anything to encourage landfill expansion.

Oounty ~issior~r Haas stated that she has not been ixesented with a
resolution. (bunty Om~issioner Haas stated that she is willing to take
Ramsey's position t~ader the l~w but she has another law and that is the law
that says solid waste is the county's responsibility.

I
I
I
I

PUBLIC HF_ARII~V.~

~e regular Gouncil meeting adjourned at 8:03 p.m.
following l~h] ic hearings:

1.

2.

in order to conduct the

Revenue Sharing Proposed Use Hearing.

Request to build an aocessory structure larger than allowed by City
O~; case of Mr. Donald Ness.
August 27, 1985

Page7 of 28
