Mr. Ness stated that his request before the Board of Adjustment is for a building 6' larger than what code all.s! he needs room to store materials along with the truck. Mayor Hei~an stated that the rules have been in place got s~e time. Mrs. Ness stated that in April, before they purchased ~he lxoperty, they were told by the Building Inspector that if they wanted to operate a business frc~ their hc~e, all they had to do was apply for a oonditional use permit and it would be granted. Mrs. Ness stated that the ha~e imp~ov~ent business is their livelihood. Mrs. Ness stated that she and her husband have imprcwed the property considerably since they purchased it and the City was being grossly unfair in changing the findings of fact. Mrs. Ness stated that she and her husband are trying to take care of their r~-cds legally while neighbors are violating City codes; that she and her husband oould have just built the garage. Mrs. Ness stated that appro~ing the oonditional use permit and approving the size building they need to store their equi~ment will improve the looks of the lxoperty and it will not be a hazard to anybody in any way. Mrs. Ness requested that Council reoonsider the request. Gouncilm~mber Gox stated that he is not willing to reoonsider; 24' x 26' should suffice with sa~e additional height to the building; Ramsey's business sector is being taxed 4 to 5 times more than the residential areas and Council should not be enoouraging business growth in R-1 districts. Mayor Hei~an and Councilme~bers Reimann and Scklueter stated that they will not reconsider the request. ~ayor HeiU~an stated that enforcement af these ordinanoes is on the Council age~da for discussion this evening; if the City is going to be consistent, we have to start enforcing the ordinanoes. ~zs. Ness stated that the rules are being enforced after she and her husband were misled and made ap~ication. Mrs. Ness inquired as to bow she can appeal Council' s decision. Mayor Hei~an stated that she could get that information frcm Mr. Goodrich. Tax Increment Financing: Adoption Of Develo_~ment Progra~ For Develo_rm~ne District No. 1 And The Tax Increment Financing_ Plan For Tax Increment Fin~c~_ District No. 1: Ms. Arlin Waelti was present. Ms. Waelti spoke to Council's concern regarding whether tax increment generated from a housing area could be used in an industrial area and stated that it can be dome but statutorily the City has to have a 'but for' benefit. Ms. Waelti stated that p~c~ect areas do not have to be contiguous and tax incr~ents frc~ orm district can be spent anywhere in the p~oject area. According to the State August 27, 1985 Page 22 of 28
