I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />i <br />I <br />i <br />I <br />I <br />I <br />I <br /> <br />-4- <br /> <br /> E. outdoor storage areas are protected from unauthorized <br />access and inadvertent damage from vehicles or equipment; <br /> <br /> F. all containers in outdoor storage areas which hold <br />free liquids are placed on a curbed surface which is <br />impermeable to the waste stored. <br /> <br />The Agency alleges that the Company accumulated and stored hazardous <br /> <br />wastes in containers, in violation of these rules. <br /> <br />c. Minnesota Rules pt. 7045.0292, subp. 1.H. states: <br /> <br /> H. the requirements of parts 7045.0558 and 7045.0566 to <br />7045.0572 are fulfilled regarding personnel training, <br />preparedness, prevention, and contingency planning. <br /> <br />The Agency alleges that the Company failed to provide and document the <br /> <br />required personnel training and to prepare a written contingency plan, in <br /> <br />violation of this rule. <br /> <br />d. Minnesota Rules, pt. 7045.0221 states: <br /> <br />Prior to transportation, treatment, storage, or disposal <br />of any hazardous waste a generator must obtain a generator <br />identification number on forms provided by the director. <br /> <br />The Agency alleges that the Company failed to obtain the required <br /> <br />EPA identification number, in violation of this rule. <br /> <br />e. Minnesota Rules, pt. 7045.1020, subp. A. and B. states: <br /> <br />A. Each generator who produces a hazardous waste within <br />the county shall submit a disclosure and annual reports <br />to the county as required by the county ordinance in lieu <br />of submission to the agency unless specifically requested <br />in writing'by the director to submit a copy of the <br />disclosure or annual report to the director; and <br /> <br />B. All persons shall comply with all other requirements of <br />this chapter, the agency's permittinU procedures, and all <br />requirements of the county ordinance. <br /> <br />The Agency alleges that the Company failed to prepare and submit a <br /> <br />di~.-llos,Jre and annual reports to Anoka County, in violation of this rule. <br /> <br />m <br /> <br /> <br />
