In the event that <br />the submittal is disapproved in whole or in part, the Agency Director shall <br />notify the Company of the specific inadequacies and shall indicate the necessary <br />amendments or revisions, within fifteen (15) calendar days of receipt of any <br />notice of disapproval, the Company shall submit revisions to correct the <br />inadequacies. Upon approval by the Agency Director, the submittal shall be <br />considered a part of the Agreement and shall be implemented by the Company as <br />specified in the approved schedule. <br /> <br /> 5. Agency. In consideration of the Company's performance of the terms, <br /> covenants, and agreements contained herein, the Agency agrees that for such <br /> period of time as the Company is in compliance with this Agreement it shall <br /> stand in lieu of any administrative, legal and equitable remedies available to <br /> the Agency regarding the alleged violation of Minnesota rules described in <br /> paragraph A.6. of this Agreement, except that nothing in this Agreement shall <br /> preclude the Agency from exercising any administrative, legal or equitable reme- <br /> dies available to it to require additional efforts by the Company in the event <br /> that the implementation of paragraph D.1. does not eliminate or abate any <br /> pol)uti,)n or contamination or threat thereof .'esulting from the violations set <br /> forti~ in paragraph A.6. <br /> <br /> 6.
