I I I I I I I ,I I I I Minnesota Pollution Control Agency CERTIFIED MAIL RETURN RECEIPT REQUESTED June 28, 1985 Mr. Ramon Burton Waltek, Incorporated 14310 Sunfish Lake Boulevard Anoka, Minnesota 55303 Dear Mr. Burton: Re: Stipulation Agreement Waltek, Incorporated As a result of the complaint investigation and inspection conducted on March 29, 1985 and subsequent communications with Ainars Silis of my staff, this letter transmits a copy of the proposed Stipulation Agreement (Agreement) between Naltek, Incorporated and the Minnesota Pollution Control Agency (MPCA). On April 26, 1985 the MPCA sent Waltek, Incorporated a Notice of Violation.(NOV) which listed several State violations noted at the company site. In addition, the NOV outlined those activities the company would be required to perform to achieve compliance with State waste regulations. The 1,1PCA staff would prefer to resolve tile company's violations through the enclused Agreement. This document is a two-party agreement which lists the aileged violations, sets forth a compliance schedule to ensure that all remaining violations are resolved, establishes a monetary penalty commensurate ¥~ith the degree of past noncompliance and provides assurances that the MPCA will not ,.:~mmence legal actions against wal~ek, Inc. if compliance with the Agreement i.~ m,~intained. The monetary penalty amount in the proposed Agreement will be honored by the IqPt;A if negotiations are fruitful and an Agreement is reached within ninety (90) days of your receipt of the proposed Agreement. The penalty amount may increase if good faith negotiation efforts have not resulted in an Agreement within the ninety (90) day negotiations period. Further, Part B(1) of the Agreement sets out compliance dates by which hazardous waste rule violations must be addressed whether or not the proposed Agreement is signed. Failure to complete tile ';reps required by Part B (1) of the Agreement by the dates set out in the prop,,~ed Agreement may also affect the ~4PCA's position on the penalty amount that is appropriate in this case. ?hot, .' ....................
