I <br /> <br />I <br />I <br /> <br /> I <br /> I <br /> <br /> I <br /> I <br /> <br />,I <br /> <br /> I <br /> I <br /> I <br /> <br />Minnesota Pollution Control Agency <br /> <br />CERTIFIED MAIL <br />RETURN RECEIPT REQUESTED <br /> <br />June 28, 1985 <br /> <br />Mr. Ramon Burton <br />Waltek, Incorporated <br />14310 Sunfish Lake Boulevard <br />Anoka, Minnesota 55303 <br /> <br />Dear Mr. Burton: <br /> <br />Re: Stipulation Agreement <br /> Waltek, Incorporated <br /> <br />As a result of the complaint investigation and inspection conducted on <br />March 29, 1985 and subsequent communications with Ainars Silis of my staff, <br />this letter transmits a copy of the proposed Stipulation Agreement (Agreement) <br />between Naltek, Incorporated and the Minnesota Pollution Control Agency (MPCA). <br />On April 26, 1985 the MPCA sent Waltek, Incorporated a Notice of Violation.(NOV) <br />which listed several State violations noted at the company site. In addition, <br />the NOV outlined those activities the company would be required to perform to <br />achieve compliance with State waste regulations. <br /> <br />The 1,1PCA staff would prefer to resolve tile company's violations through the <br />enclused Agreement. This document is a two-party agreement which lists the <br />aileged violations, sets forth a compliance schedule to ensure that all <br />remaining violations are resolved, establishes a monetary penalty commensurate <br />¥~ith the degree of past noncompliance and provides assurances that the MPCA will <br />not ,.:~mmence legal actions against wal~ek, Inc. if compliance with the Agreement <br />i.~ m,~intained. <br /> <br />The monetary penalty amount in the proposed Agreement will be honored by the <br />IqPt;A if negotiations are fruitful and an Agreement is reached within ninety (90) <br />days of your receipt of the proposed Agreement. The penalty amount may increase <br />if good faith negotiation efforts have not resulted in an Agreement within the <br />ninety (90) day negotiations period. Further, Part B(1) of the Agreement sets <br />out compliance dates by which hazardous waste rule violations must be <br />addressed whether or not the proposed Agreement is signed.
