Access. The Company shall allow the Agency or any authorized <br />member, employee or agent thereuf, upon presentation of credentials, access at <br />reasonable times to the Company's property and facilities to obtain such <br />information and documentation which is relevant to making a determination that <br />tile Company is in compliance with the terms of this Agreement. <br /> <br /> 3. Stipulated Civil Penalties. <br /> <br /> a. Past Violations of Agency Rules. Within thirty (30) days of the <br /> <br />effective date of this Agreement the Company shall pay into the Environmental <br />Response, Compensation and Compliance Fund of the Treasury of the State of <br />Minnesota the sum of Twenty-Two Thousand Dollars ($22,000) as a civil penalty <br />for past noncompliance with statutes and rules cited in paragraph A.6. of this <br />Agreement. <br /> <br /> b. Violations of this Agreement. In the event the Company violates <br /> a provision or provisions of this Agreement, the Company shall pay into the <br /> Environmental Response, Compensation and Compliance Fund of the Treasury of the <br /> State of Minnesota the sum of One Hundred Dollars ($100) for each day that the <br /> company fai~s to comply with the time schedules containe~l in paragraph B.1. of <br /> this Agreement. The Company shall not be liable for payment under this sub- <br /> paragraph if it has submitted to the Agency Director a timely request for an <br /> ,~xtension of time under paragraph 6.f. and such request has been granted. <br /> <br /> Upon determination by tile Agency Director that' the Company has failed <br /> to make a submittal or to complete work in accordance with the required time <br /> schedule, the Agency Director shall give written notice to the Company of tile <br /> <br /> <br />
