City Staff recommends granting the moratorium exception to Mr. John Rowe.

Motion by Councilmember Cook, seconded by Councilmember Elvig, to adopt Resolution #04-
07-185 adopting Findings of Fact #0685 stated in the 5 criteria for granting exceptions to the
Moratorium Ordinance, and approving Mr. John Rowe's request for an exception to the
Moratorium Ordinance to subdivide 6530 Green Valley Road for the purpose of separating the
greenhouse fi'om the homestead.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Elvig, Pearson, Strommen,
and Zimmcrman. Voting No: None. Absent: Councilmember Kurak.

Mr. John Rowe, 17059 Nowthen Boulevard, expressed his appreciation to the City Council and
City Staff for their assistance with this matter.

Case #11: Request for Site Plan Review; Case of Hermanson Homes

Community Development Director Frolik stated that Hermanson Homes is proposing to
construct a 10,000 square foot multi-tenant office building on the property located on the
southeast corner of Armstrong Boulevard and Riverdale Drive. The proposed office building is
located in the B-2 Highway Business District and is listed as a permitted use in that district. The
subject property is approximately 1.35 acres and has a total lot coverage of 18% (35% is the
maximum in the B-2 District). The proposed building meets the required setbacks in this zoning
district.

Community Development Director Frolik stated the revised landscaping plan will be acceptable
with the addition of 8 shrubs to the bufferyard adjacent to the residential property to the south.
The Planning Commission recommended the applicant construct a 6-foot privacy fence along the
south property line, similar to the one Pleasureland RV was asked to install. The applicant is
agreeable to installing this fence. She advised the building elevations have been revised to show
a combination of brick and masonry block, which meets City Code. The grading and drainage is
generally acceptable. City sewer and water will be constructed through the Town Center site this
smnmer, across Highway 10 to the intersection of Highway 10 and Armstrong Boulevard, about
400 feet fi'om the site. Staff anticipates that services will be at this intersection in October 2004.
The proposed development will be required to hook up to City services. She stated the Planning
Commission and Staff are recommending approval of the proposed site plan, contingent upon
compliance with the City Staff Review Letter dated April 30, 2004, revised July 7, 2004 and the
developer signing the Development Permit.

Motion by Councilmember Pearson, seconded by Councilmember Cook, to approve the site plan
contingent upon compliance with the City Staff Review Letter dated April 30, 2004, revised July
7, 2004 and the developer signing the Development Permit.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Pearson, Cook, Elvig, Strommen,
and Zimmerman. Voting No: None. Absent: Councilmember Kurak.

City Council/July 13, 2004
