Motion by Councihnember Cook, seconded by Councilmember Pearson, to adopt Ordinance <br />#04-29 rezoning the subject property to Planned Unit Development (PUD), based on findings of <br />fact. <br /> <br />A roll call vote was performed: <br /> <br />Councilmember Cook aye <br />Councilmember Elvig aye <br />Councilmember Kurak (absent) <br />Councilmember Pearson aye <br />Councihnember Strommen aye <br />Councilmember Zimmerman aye <br />Mayor Gamec aye <br /> <br />Motion carried. <br /> <br />Case #15: <br /> <br />Adopt Ordinance to Establish Board of Appeals and Adjustments/Official <br />Maps <br /> <br />City Administrator Norman stated the adoption of the ordinance establishing the Official Map <br />requires the establishment of a separate Board of Appeals and Adjustments/Official Maps. The <br />ordinance which established the Board of Appeals by amendment of Chapter 2 of the City Code <br />which is titled "Council, Boards and Commissions" was introduced on June 22, 2004, and is now <br />being presented for formal adoption. Staff recommends adoption of the ordinance. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Pearson, to adopt Ordinance No. <br />30 to amend Chapter 2 of the City Code by adding a Board of Appeals and Adjustments/Official <br />Maps. <br /> <br />City Administrator Norman stated the deadline for applications for the Board of Appeals is July <br />and an update will be provided in August with respect to those applications. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Pearson, Elvig, Strommen, <br />and Zimmerlnan. Voting No: None. Absent: Councilmember Kurak. <br /> <br />Case #16: <br /> <br />Adopt Ordinance to Vacate Easement in Rivenwick Village; Case of Turtle <br />Moon, Inc. <br /> <br />Comnmnity Development Director Frolik stated that the City Council recently granted final plat <br />approval to Rivenwick Village, a replat of Outlot A of Rivenwick 3rd Addition, into mixed use <br />plmmed unit development consisting of 140 dwelling units in the southeast quadrant of Highway <br />10 and Riverdale Drive NW. The underlying outlot that makes up the plat contains a drainage <br />and utility easement for a ponding area. That ponding area was reconfigured with the plat of <br />Rivenwick Village. On June 22, 2004, the City Council conducted a public hearing and <br />introduced an ordinance to vacate the underlying drainage and utility easement, hi accordance <br /> <br />City Council/July 13, 2004 <br />Page 22 of 24 <br /> <br /> <br />
