PLANNING AND ZONING COMMISSION CITY OF RAMSEY ANC~A OGJNTY $~TE OF MINNESfXI~ A regular meeting of the Ramsey Planning and Zoning Commission was held on Tuesday, December 4, 1984 at the Ramsey Municipal Center, 15153 Nowthen Blvd. N.W., Ramsey, Minnesota. Members Present: Mr. Kenneth Peterson, fhairman Mr. Gerald Zi~merman Mr. Benjamin Dee~er Mr. Terry Hendriksen Also Present: City Attorney William Goodrich City Building Official Clayton Berg City Planner Anne Norris Members Absent: Mr. C~arles LaDue Mr. Lee Johnson Dr. Duane Kennen Chairman Peterson called the regular meeting of the Planning and Zoning ~ission to order at 7:36 p.m. Roger Hermanson - 15115 Garnet St. D~ - Stated that on Sept~pber 10, 1984, this Planning Oorm~ission denied Waste Management's request for an expansion permit and he feels that this mining permit falls into the same category. Chairman Peterson replied that the C~,,,ission's action at that time was in regards to expansion and this request for a mining permit is not an expansion. CoJ,~,issioner De~er stated that the mining permit is to excavate dirt for cover at the existing landfill. City Attorney Goodrich stated that legally speaking, the Commission, in it's decision making process, must divorce the intended use from the act of extraction. Douglas Fountain - 15255 Garnet St - Stated that this request for a mining permitbyWasteManagement is essentially another form of a conditional use permit wich will allow removal of soil from one area to cover waste at the landfill site. Even though a mining permit will not expand the landfill acreage wise, Waste Management will be acoomplishing what they requested in May of 1984 and were denied in Sept~msber of 1984. We will be forced to continue to put up with the smell, noise,-dust and property devaluationaswas recognized by Council and added to their findings of fact on September 10, Page 1 of 10
