Within a reasonable time after the hearing, the Board of Adjustmer~t shall make its order deciding the matter and serve a copy of such order upon the appellant or the petitioner by mail. This shall be the final action of the City on the variance appl icat ion. All costs incurred by the City in processing an application of a conditional use permit, and temporary conditional use permit, site plan review, or variance shall be paid by the applicant. Said costs shall include but not be limited to: professional consulting services as directed by the Planning Commission, Board of Adjustrnent,and/¢,r City Council, copying charges, extraordinary City staff inv¢,lvemer~t, public hearing publications, and written notice to adjacent property owners. A set fee established from tirde to time by the City Council shall be deposited with the City at the time the respective application is made. At the time the applicati¢,n is made, if the Zoning Officer determines that costs in addiitic, n to the set fee will likely by incurred by the City, ther~ an additional surd as determined by the zoning officer shall be depc, sited with the City. Any portion of those funds deposited but not expended shall be returned to the applicant after final act ion on the application. Board of Adjustment The City Council shall act as the Board of Adjustment and shall elect a chairman and vice-chairman and appoint a secretary. It shall hold meetings, keep minutes and, pursuant to not ice, shall conduct hearings, take testimony under oath, and render decisions in writing within 45 days after the hearing or continued hearing. A fee shall be charged in accordance with a schedule annually affixed by resolution for any appeal or proceeding filed with the Board of Adjustment. The Board of Adjustment shall have the power to hear and decide appeals from any order, requirement, decision, grant, or refusal made by the zoning officer in the administration of this ordinance. An appeal shall be in writing and filed in duplicate with the zoning officer. Within 10 days after filing of the appeal, the zoning officer shall transmit to the Board of Adjustment all papers involved in the proceedings. Upon receipt of this material, the Board of Adjustment shall set a hearing date and give notice by mail of the time, place and purpose thereof to the appellant and to the zoning officer. The Board of Adjustment may reverse or affirm wholly or in part any ruling, decision, or determinatior~ of the zoning officer and may issue or direct the issuance of a permit. The decision of the Board of Adjustment may be appealed to the District Court. Enforcement Penalties
