I <br /> I <br /> I <br /> <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br />I <br />I <br />I <br />I <br />I <br /> <br />narnes and addresses of property owners within 350 feet of the <br />property whereon the variance is requested shall be submitted <br />with, and made a part of, the application for variance. <br /> <br />Within a reasonable time after the hearing, the Board of <br />Adjustmer~t shall make its order deciding the matter and serve a <br />copy of such order upon the appellant or the petitioner by mail. <br />This shall be the final action of the City on the variance <br />appl icat ion. <br /> <br />All costs incurred by the City in processing an application of a <br />conditional use permit, and temporary conditional use permit, <br />site plan review, or variance shall be paid by the applicant. <br />Said costs shall include but not be limited to: professional <br />consulting services as directed by the Planning Commission, Board <br />of Adjustrnent,and/¢,r City Council, copying charges, extraordinary <br />City staff inv¢,lvemer~t, public hearing publications, and written <br />notice to adjacent property owners. A set fee established from <br />tirde to time by the City Council shall be deposited with the City <br />at the time the respective application is made. At the time the <br />applicati¢,n is made, if the Zoning Officer determines that costs <br />in addiitic, n to the set fee will likely by incurred by the City, <br />ther~ an additional surd as determined by the zoning officer shall <br />be depc, sited with the City. Any portion of those funds deposited <br />but not expended shall be returned to the applicant after final <br />act ion on the application. <br /> <br />Board of Adjustment <br /> <br />The City Council shall act as the Board of Adjustment and shall <br />elect a chairman and vice-chairman and appoint a secretary. It <br />shall hold meetings, keep minutes and, pursuant to not ice, shall <br />conduct hearings, take testimony under oath, and render decisions <br />in writing within 45 days after the hearing or continued hearing. <br />A fee shall be charged in accordance with a schedule annually <br />affixed by resolution for any appeal or proceeding filed with the <br />Board of Adjustment. <br /> <br />The Board of Adjustment shall have the power to hear and decide <br />appeals from any order, requirement, decision, grant, or refusal <br />made by the zoning officer in the administration of this <br />ordinance. An appeal shall be in writing and filed in duplicate <br />with the zoning officer. Within 10 days after filing of the <br />appeal, the zoning officer shall transmit to the Board of <br />Adjustment all papers involved in the proceedings. Upon receipt <br />of this material, the Board of Adjustment shall set a hearing <br />date and give notice by mail of the time, place and purpose <br />thereof to the appellant and to the zoning officer. The Board of <br />Adjustment may reverse or affirm wholly or in part any ruling, <br />decision, or determinatior~ of the zoning officer and may issue or <br />direct the issuance of a permit. The decision of the Board of <br />Adjustment may be appealed to the District Court. <br /> <br />Enforcement Penalties <br /> <br /> <br />
