I <br />I <br />! <br />I <br />I <br /> <br />'I <br /> <br /> 2 <br /> <br /> 3 <br /> <br /> 4 <br /> <br /> 5 <br /> <br /> 6 <br /> <br /> 9 <br /> <br /> 10 <br /> <br /> 11 <br /> <br />ORDINANCE NO. 971 <br /> <br />AN ORDINANCE AMENDING CIiAPTEH 27 OF THE HURST CODE OF ORDINANCES, <br />THE COMPREHENSIVE ZONING ORDINANCE, BY ADDING THERETO A NEW <br />SECTION XV A: fl-PS RESIDENTIAL PERFORMANCE STANDARD DISTRICT; <br />PROVIDING A PURPOSE; PERMITTED USES; PERFORMANCE STANDARD USES; <br />CONDITIONAL USES; PERFORMANCE STANDARDS; PROCEDURE FOR REVIEW AND <br />APPROVAL OF PERFORMANCE STANDARD USES; PERFORMANCE STANDARD <br />FORMS; ESTABLISHING A PENALTY, AND PROVIDING FOR PUBLICATION. <br /> <br />WHEREAS, the City Council has authorized the drafting of a new <br /> zoning ordinance provision for residential developments <br /> in order to promote additional f}exibility, innovative <br /> design and a high quality residential environment in the <br /> City; and, <br /> <br />WHEREAS, the City Council and Planning and Zoning Commission have <br /> held a public workshop to consider a zoning district <br /> that would accomplish such objectives; and, <br /> <br /> I <br /> I <br /> I <br /> I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />12 <br />13 <br />14 <br /> <br />15 <br /> <br />16 <br /> <br />17 <br /> <br /> 18 <br /> <br /> 19' <br /> <br /> 20 <br /> <br /> 22" <br /> 2:3 <br /> 24 <br /> 25 <br /> 26 <br /> <br />WHEREAS, the City Council has received the recommendation of the <br /> Planning and Zoning Commission on such new district, <br /> which recommendation was made after the holding of a <br /> public hearing before said Commission on such matter; <br /> <br />'WHEREAS, notice has been published of the time and place of a <br /> public hearing held before the City Council on sUch <br /> matter, which hearing Nas been duly held; and, <br /> <br />~HEREAS, the City Council has determined that the amendment <br /> to the C°mprehensive Zoning Ordinance is in the best <br /> interest of the health, safety, and general welfare <br /> Of 'the citiz.enS of the City of Hurst; .and, <br /> <br />'~HE~EA8, the City CounCil desires to promote the sound <br /> development of the remaining vacant residential <br /> that is inconsistent with and harmful to %he quality <br /> of new.development in the City; and, <br /> <br />=WHERE~S, the City Council has determined that the Present zoning <br /> district categories do not adequately provide for such <br /> residential development objectives to be achieved; NO,I," <br /> THEREFORE, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HURST, TEXAS <br /> <br />~ec. 1. TI{AT Chapter 27 of the Hurst Code of Ordinances, the <br /> Comprehensive'Zoning Ordinance, be amended by'adding <br /> thereto a new Section XV A as follows-' <br /> <br /> <br />
