Chairman Peterson stated that the recodification will be gone through again <br />and there is also a public hearing to be conducted. <br /> <br />Commissioner Dee~er proceeded to report some additional highlights of the <br />Zoning Seminar: <br /> <br />1. State statutes override charter law and State statutes do not provide for <br />temporary conditional uses in any form. Putting a time limit on a oonditional <br />use is illegal; an expiration clause can be included but it is only binding on <br />the person signing the permit -- it does not bind future owners of the <br />property. ~e only way for a City to get around this is to draw up it's own <br />'temporary use permit' and not use the term 'conditional' in the title. <br />It se~ns that all of the disputes regarding uses within a zone comes down to <br />definitions of buildings and business types; in every case where the use being <br />tried was not defined, the property owner won. ~here are many municipalities <br />in the Country that are going to defining their zoning and setting the <br />criteria rather than defining the businesses that will be allowed; there are <br />no conditionals. <br /> <br />Commissioner Deemer stated that there is going to be a seminar on special <br />permits and oonditional uses that he would like to attend but it is not being <br />oonducted in the Metro area. <br /> <br />Chairman Peterson suggested that Ms. Norris determine if there is enough <br />interest on the part of cities in the Metro area regarding the seminar on <br />special permits and conditional uses and pursue having that seminar offered in <br />the Metro area. <br /> <br />Commissioner DeE~er also noted that there is a seminar coming up on Rezoning <br />and he plans to attend. <br /> <br />~ Dis. cussi.o.n.: Re~°a.~r~di?lq Rec~difica~iog.
