Mr. <br />Moersfelder stated that he has talked with the City Attorney and Metro Council <br />attorney and it is assured that if Ramsey takes action on this permit request, <br />that action will not be appropriate until development limitations have been <br />lifted; Waste Management of Minnesota, Inc. knows full well they have other <br />places to go (County and Metro Council) after getting Ramsey's approval. <br /> <br />City Administrator Schnelle stated that he doesn't understand why Metro <br />Council and County don't address this request prior to Ramsey making a <br />decision. ~hose agencies want the City to make the first move while they sit <br />behind the law; then the City takes action and those agencies claim they <br />acted accordingly because the City authorized the develolmlent. <br /> <br />Mayor Heitman requested that the City Engineer identify what requirements <br />would be necessary in order to make a decision at tonight's meeting. <br /> <br />Mr. Goodrich replied that Council should: i) Consider and adopt findings of <br />fact based on what has been heard at public hearing from applicant and <br />citizens and back-up material that has been provided; 2) Based on those <br />findings of fact, Council must take action to accept, deny or condition the <br />application. Mr. Goodrich stated that findings of fact are required pursuant <br />to corm~on law in Minnesota. ~he findings of fact can be drafted by Council <br />this evening or Council can direct Staff to prepare findings of fact to be <br />brought back to Council for review and adoption. Mr. Goodrich stated that the <br />law states that the findings of fact have to be adopted contemporaneously with <br />the decision making. <br /> <br />Mayor Heitman inquired if Waste Management of Minnesota, Inc. has any <br />additional information they wish to present. <br /> <br />Mr. Moersfelder stated that Waste Management of Minnesota, Inc. has provided <br />all information necessary to meet the criteria of the temporary conditional <br />use permit ordinance. <br /> <br />Councilm~r Cox stated that the decision now is whether or not to have Staff <br />prepare findings of fact for Council adoption at a follow-up meeting and to <br />allow for written input on the issue. Councilmember Cox stated that he is <br />ready to act tonight; that he is very supportive of the public hearing process <br />which he helped initiate in Ramsey. Councilmember Cox further commented that <br />the mining process has been bastardizing the City in that it is operated <br />without preparing for future use of the oonm~unity. CouncillOr COx stated <br />that he doesn't believe that any one of the councilmembers, regardless of the <br />decision made tonight, desire expansion of the landfill. Councilmember Cox <br />stated that he has made his feelings clear to Waste Management of Minnesota, <br />Inc. and he will support anything that will close that facility. <br />Councilmember COx referred to Mr. Roger McCully's oormments at the public <br />hearing and agreed that anything Council does in this case has to be done in a <br />prudent rm~nner taking into consideration protection for the community in years <br />to oome.
