's <br />request for expansion, Council gave Staff some direction as to the preparation <br />of the findings of fact and requested some further direction regarding these <br />findings of fact proposed to be prepared. <br /> <br />Council~mber Schlueter stated that as she recalls it, Council's direction to <br />Staff on the findings of fact for the expansion request was to include all <br />pros and oons to the issue. <br /> <br />Councilm~ber Cox stated that some of the input Staff is looking for is in the <br />Planning and Zoning reconm~ndations; time limitations; consider the fact as <br />it relates to Site P approval; how it allows for utilization of property, if <br />necessary, to provide proper coverage to insure protection; other aspects as <br />it relates to the entire site. Councilmember Cox stated that it should be <br />strongly indicated to those agencies above Ramsey that this is a very <br />important issue; those agencies say they want the opportunity for the City's <br />input; any input the City has given has been misconstrued to make Council look <br />like it's on the wrong end. Councilm~mber COx stated he is not limited to <br />taking citizen con~ents at meetings only. <br /> <br />Mr. Goodrich stated that one of the facts, in the findings of fact basket, <br />would be that Metro Council and County have not lifted the development <br />moratorium. Mr. Goodrich also noted that this Council can conclude, based on <br />the moratorium fact, to deny the mining permit request and not go forward <br />until Metro Council and County have addressed the issue. <br /> <br />Councilmembers Schlueter and Reimann expressed that all other facts really <br />have no bearing on the decision oonsidering there is a State statute for a <br />moratorium on all development that has not been lifted; the issue is dead. <br /> <br />Councilmember Cox pointed out that if an individual, other than Waste <br />Management, owned the property and requested a mining permit, they would <br />approach the City first. <br /> <br />Mr. Goodrich replied that the applicant could come to the City first, but it <br />would be wiser to approach the County and Metro Council first. <br /> <br />Mr. Schnelle stated that it would be foolish for the City to move ahead on <br />this before all the "i's" are dotted and "t's" crossed; the same type of <br />situation exists in the City today for persons owning and wanting to develop <br />property under the jurisdiction of agencies above the City level. <br /> <br />Motion by Councilmember Schlueter to disapprove of Waste Management of <br />Minnesota, Inc. 's request for a t~mmporary conditional use permit for mining on <br />the following described property: <br /> <br />~he South Half of the Northeast Quarter of Section 27, Township <br />32, Range 25, Anoka County, Minnesota. <br /> <br />Further Discussion: Mayor Hei~an cautioned against disapproving the request <br />prior to adopting findings of fact.
