PROPOSED FINDINGS OF FACT <br />DENNIS K. KRUEGER <br /> <br />1. ]hat Mr. Dennis K. Krueger, hereinafter referred to as "Applicant," <br />has properly applied for a conditional use permit to operate a <br />video rental business from a portion of his unattached garage in <br />an R-1 residential district. <br /> <br />2. ]hat the Applicant appeared before the Planning and Zoning <br />Con~ission for a public hearing pursuant to City Ordinance on <br />March 5, 1985. ]hat said public hearing was properly advertised <br />and minutes of that public hearing are hereby incorporated by <br />reference. <br /> <br />3. ]hat the property which is the subject of the application is <br />known as 16300 Ramsey Boulevard NW and is legally described as <br />follows: ~hat part of the East Half of the Northwest Quarter of <br />Section 15, Township 32, Range 25, Anoka County, Minnesota, <br />described as follows: Commencing at a point in the East line of <br />said Northwest Quarter, distance 1716.86 feet South of the <br />Northeast corner thereof; thence Westerly, at a right angle to <br />said East line, 288 feet; thence at a right angle North 100.42 <br />feet to actual point of beginning of tract of land to be <br />described; thence continuing North along last described course <br />165.58 feet; thence at a right angle East 288 feet to the East <br />line of said Northwest Quarter; thence North 352.36 feet along <br />said East line to a point 1545 feet North of the Southeast corner <br />of said Northwest Quarter; thence at a right angle West to the <br />East line of the West 300 feet of the said East Half of the <br />Northwest Quarter; thence South to the Southeast corner of the <br />West 300 feet of the North 1175 feet of the East ~alf of said <br />Northwest Quarter; thence East parallel with the North line of <br />said Northwest Quarter a distance of 90 feet; thence South 49 <br />degrees, 58 minutes, 36 seconds East, 671.5 feet; thence Easterly <br />120 feet to actual point of beginning. For purposes of this <br />description the East line of said Northwest Quarter is assumed to <br />bear North 0 degrees, 05 minutes, 54 seconds East. Subject to <br />road easement over the East 50 feet thereof. <br /> <br />4. ]hat the subject parcel is approximately5 acres and is <br />located in an R-1 Residential District. <br /> <br />5. ]hat the Standards for Consideration are as follows: <br /> <br />a) ]hat the property is zoned R-1 and operating a video <br /> rental business is not a permitted use in this zone; <br /> <br />b) ]hat the adjoining properties contain residences; <br /> <br />c) ]hat there are no other similar uses in a residential <br /> zone in the City of Ramsey; and <br /> <br />d) ]hat the proposed use will not be detrimental to persons <br /> residing in the vicinity of the use or the general public <br /> <br /> <br />
