Voting Yes: Mayor Beitman, Councilmembers Sorteberg, COx, <br />Reimann and Schlueter. Voting No: None. <br /> <br />C~aDter 8 Of ~ne C~tv t~hart~r T~ Cnnform Wfth Minne~ot~ <br /> <br />Mr. Schnelle stated that he received a letter from Mr. Kennedy, Ramsey's <br />bonding attorney, in which it is stated that the problem with City Charter <br />deviating from State Statute 429, is that City ordinance has never been tested <br />in oourt. <br /> <br />Mayor Beitman stated that the Charter Oommission is meeting on February 28 and <br />will review some of this information. <br /> <br />Councilmember Cox stated that one of the problems during Charter preparation <br />was that the Charter Cc~mission would cut short those persons trying to <br />provide input to the Charter that would have been beneficial to the community. <br /> <br />Mr. Schnelle stated that this issue has nothing to do with the City's bond <br />rating; investment bankers question situations where a city ordinance exceeds <br />State statute. Mr. Schnelle stated that going back to State Statute 429 <br />regarding going for bonds will not Qhange process outlined in the Charter to <br />get to that point. <br /> <br />Motion by Councilmember Reimann and seoonded by Councilmember COx to recommend <br />that the Charter Gommission consult with Mr. Kennedy of LeFevere, Lefler, <br />Kennedy, O'Brien & Drawz regarding concerns with Chapter 8 of City Charter. <br /> <br />Motion carried.
