PROPOSED FINDINGS OF FACT <br />JOSPEH J. NYARA <br /> <br />1. That Mr. Joseph Nyara, hereinafter referred to as <br />"Applicant," has properly applied for a conditional use permit to <br />operate a beauty shop from his home at 5320 155th Lane N.W. <br /> <br />2. ~at the Applicant appeared before the Planning and Zoning <br />Commission for a public hearing pursuant to City Ordinance on <br />April 2, 1985. That said public hearing was properly advertised <br />and minutes of that public hearing are hereby incorporated by <br />reference. <br /> <br />3. ~hat the property which is the subject of the application is <br />legally described as follows: <br /> <br />~hat part of the North Half of Section 24, Township 32, <br />Range 25, Anoka County, Minnesota, described as follows: <br />Lot 6, Block 5, Woodland Green, subject to easement. <br /> <br />4. That the subject parcel is approximately 1 acre and is <br />located in an R-1 Residential District. <br /> <br />5. ~hat the Standards for Consideration are as follows: <br /> <br />a. ~hat the property is zoned R-1 and a beauty shop is <br /> not a permitted use in this zone; <br /> <br />b. ~hat the adjoining properties are residential dwelling <br /> units on approximately one acre lots; <br /> <br />c. ~hat there would be no change in the traffic flow to the <br /> area; <br /> <br />d. ~hat there are other similar uses in the City of Ramsey; <br /> and <br /> <br />~at the proposed use will notbe detrimental to persons <br />residing in the vicinity of the use or the general public <br />and will not substantially impair the enjoyment or value <br />of properties in the area. <br /> <br />6. ~hat the Criteria for Approval/Disapproval are as follows: <br /> <br />~hat the Applicant's request is to operate a beauty shop <br />from his home and that properly maintained, this will not <br />be detrimental to or endanger the public health, safety <br />or general welfare and is not contrary to other govern- <br />mental standards of regulations; <br /> <br />That the proposed use will not be unsightly or <br />undesireable or obnoxious in appearance and it will not <br />hinder the orderly and harmonious develoI~nent of the <br />R-1 district of the City; <br /> <br /> <br />
