That Mr. Bud Sauter, hereinafter referred to as "Applicant," <br />has properly applied for a conditional use permit to mine fill <br />from his property at the northeast corner of the intersection of <br />Industry Avenue and Sunfish Lake Boulevard. <br /> <br />2. ~hat the Applicant appeared before the Planning and Zoning <br />Commission for a public hearing pursuant to City Ordinance on <br />April 2, 1985. ~hat said public hearing was properly advertised <br />and minutes of that public hearing are hereby incorporated by <br />reference. <br /> <br />3. That the property which is the subject of the application is <br />legally described as follows: <br /> <br />~he Southwest Quarter of the Southwest Quarter of Section <br />26, T~wnship 32, Range 25, Anoka County, Minnesota, except <br />the following described parcel of land: Commencing at the <br />northwest corner of said Southwest Quarter of the Southwest <br />Quarter; thence southerly, along the west line thereof, a <br />distance of 360.00 feet to the point of beginning of the <br />land being described; thence easterly, at right angles, a <br />distance of 456.00 feet; thence southerly, at right angles, <br />a distance of 220.00 feet; thence westerly, at right angles, <br />a distance of 456.00 feet,more or less, to the west line of <br />said Southwest Quarter of the Southwest Quarter, thence nor- <br />therly, along said west line, a distance of 220.00 feet to <br />the point of beginning. <br /> <br />4. That the subject parcel is approximately 37 acres including <br />right-of-way and is located in an I-1 Industrial District. <br /> <br />5. ~hat the Standards for Consideration are as follows: <br /> <br />a. That the property is zoned I-1 and mining is not a <br /> permitted use in this zone; <br /> <br />That the adjoining property to the north contains resi- <br />dential dwellings, and the property to the east, south, <br />and west is either vacant or contains co~m~ercial/indus- <br />trial structures; <br /> <br />c. That the proposed use may cause a change in the traffic <br /> flow to the area; <br /> <br />d. That there are no other authorized similar uses in the <br /> City of Ramsey; and <br /> <br />That the proposed use may not be detrimental to persons <br />residing or working in the vicinity of the use or the <br />general public and may not substantially impair the en- <br />joyment or value of properties in the area. <br /> <br /> <br />
