!
!

$10,170.

Oouncilm~nber Sorteberg stated that the difference between a State Aid and
normal city street right-of-way iA 20 feet which means an additional 25% of
land &rea is required for M.S.A.S. right-of-way; Mr. ~olm should be reimbursed
for that additional 25% of land area required which would amount to 25% of
$10,170.

Councilmember (3ox noted that if the road wasn't MSA designated and funded, Mr.
Rolm would have had to pay for the oonstruction of that road. (~ouncilme~ber
Cox also pointed out that MSA roads do not neoessarily lessen the value of the
lots on that road; some people prefer to locate on MSA roads in order to avoid
road maintenanoe asses~ents.

Mr. Schnelle stated that the $10,000 figure ~s in the ballpark because the MSA
road will solve a lot of City traffic problems and it just may be that the MSA
road will lessen the value of s~me of the lots in Flinb~ood II.

Motion by Councilmember Reimann and seoonded by Mayor Heitman, for discussion,
to offer Mr. Norm Holm $10,170 ($2,500 per acre) for the full amount of
M.S.A.S. right-of-way required through Flint~ood Hills Seoond Addition;
further, if Mr. Holm is agreeable to the offer, a resolution for same should
be presented to Council for adoption at their April 23, 1985 meeting.

Further Discussion: Mayor Heitman noted that none of the oouncilme~bers were
willing to seoond the motion, requested some additional input fr~m the
oouncilmembers and none was offered.

-Motion failed. Voting Yes: Councilmember Reimann. Voting No:
Councilmambers Sorteberg, Cox and Schlueter. Abstain: Mayor Heitman.

Councilm~mber COx stated that a reimbursement to Mr. Holm is reasonable, but
not the amount presented in the above motion because the road is being paid
for by County funds and the heavy traffic on an MSA road is beneficial to the
commercial lots in Flintwood II.

Motion by Councilm~mber Sorteberg and seoonded by Councilmember Cox to offer
Mr. Norm Holm of NE~, Inc. $2,500 per acre for that additional 25% of land
acquisition required in Flintwood Hills Seoond Addition for M.S.A.S. road
right-of-way versus a normal City street right-of-way.

Motion carried. Voting Yes: Mayor Heitman, Gouncilmembers Sorteberg, COx,
Reimann and Schlueter. Voting No: None.

D) Regu_ est For Partial Payment For Pumpbo_ ~ No. 1: Case Of A & K
Construction -

Council unanimously oonsented to dispense with the reading of the resolution.

Motion by Councilm~mber Reimann and seoonded by Mayor Heitman to adopt
Resolution #85-70 approving pay estimate no. 4 and authorizing partial payment
to A & K Construction in the amount of $44,759.63. (Please refer to
resolution file for Resolution %85-70).
March 26, 1985
