J <br /> <br /> ] <br /> <br />,J <br />J <br />I <br />J <br /> J <br /> <br /> ! <br /> I <br /> <br />proposal, the matter will be placed on the agenda for <br />the appropriate meeting of the Planning and Zoning <br />Board. <br /> <br />(b) <br /> <br />The Planning and Zoning Board shall give written notice <br />to the owners of record of all real property within 500 <br />feet, exclusive of public R.O.W., of the property lines <br />of the parcel of land for which the planned unit de- <br />velopment is proposed. The written notices may be <br />delivered personally or may be sent by mail at least 7 <br />days prior to the hearing date. Failure to deliver such <br />notice shall not affect the validity of any hearing or <br />determination by the Planning and Zoning Board. <br /> <br />(c) <br /> <br />The Planning and Zoning Board may approve, disapprove, <br />or approve with conditions the proposed planned unit <br />development. Approval of a preliminary plan shall not <br />constitute final approval of the final plan; rather it <br />shall be deemed an expression of approval of the layout <br />and densities submitted on the preliminary plan as a <br />guide to the preparation of the final plan. <br /> <br />(4) Final Plan. <br /> <br />(a) <br /> <br />Application for a final plan may be made either concur- <br />rently with the preliminary plan or after approval by <br />the Planning and Zoning Board of a preliminary plan. <br />Materials pertaining to the final plan must be submitted <br />to the Planning Division by the fifth day of the month <br />prior to the meeting of the Planning and Zoning Board <br />(for example, submittals for the February meeting, shall <br />be made by January 5th). <br /> <br />(b) <br /> <br />The final plan shall be in substantial compliance with <br />the approved preliminary plan. The final plan shall be' <br />deemed in substantial compliance with the preliminary <br />plan, provided that the final plan does not: <br /> <br />[1] Change the general use or character of the develop- <br /> ment; <br /> <br />[2] Increase the number of residential dwelling units <br /> by 1%, <br /> <br />[3] <br /> <br />Contain changes which would normally cause the <br />development to be disqualified under the applicable <br />criteria. <br /> <br /> <br />
