The City Council, upon receipt of the <br />Planning and Zoning Commission report and <br />recommendation, shall notice and hold a public <br />hearing on the application for tentative <br />developmeat plan approval in accordance with <br />the notice and hearing requirements as set <br />forth in Section XXIV for a zoning change. The <br />City Council shall consider the report and <br />recommendation of the Planning and Zoning <br />Commission, the staff report, and comments and <br />material received at the public hearing and <br />shall either (1) approve the tentative <br />development plan as submitted; (2) approve the <br />tentative development plan subject to specified <br />conditions which may include requirement for a <br />maintenance guarantee and/or a performance <br />guarantee, as may be deemed necessary by the <br />City.to assure compliance with such conditions; <br />or (3) deny the tentative development plan as <br />submittedl The City Council shall, in support <br />of its decision, make findings of fact as to <br />the following: <br /> <br />(1) whether the performance standard use <br />conI'orms with the goals, City Codes, <br />objectives and land use criteria of the City; <br /> <br />(9.) whether the performance standard use <br />conforms in all respects with the <br />performance standards of Section 15A.5; <br /> <br />~3) whether the performance standard use <br />is compatible with ad.jacent uses and/or <br />~rith .uses permissible on ad3acent sites <br />under existing, zoning; <br /> <br />(,~4'): whether the performance standard use <br />is adequately served by all necessary <br />public facilities, utilities and City <br />services; <br /> <br />~2 <br /> <br /> <br />
