Inc. And MPCA: <br /> <br />I <br />I <br />I <br />! <br />I <br />I <br />I <br />I <br />! <br /> <br />(buncilme~ber Oox stated that there is a very critical matter existing between <br />MPCA and Waltek. Oouncilm~ber {Dx stated that prior to the p~esent operator <br />at the landfill, he and Mr. Schnelle noticed ponding areas at the landfill; <br />these ponding areas lead to contamination; and at this time, PCA was putting <br />their stamp of approval to the operation of the landfill; he and Mr. Schnelle <br />worked to see that proper sloping was attained at the landfill. Councilme~ber <br />Cox stated that Waltek has been oooperating with the County to utilize the <br />methane gas at the landfill to generate electricity. At the same time Waltek <br />is working to solve probl~s created by PCA, PCA is giving Waltek the choice of <br />a 1st, 2nd or 3rd class violation and fine for improper storage of freon and <br />caustics. ~is improper storage has not created any contamination but has the <br />potential to. ~e cost of a 3rd class fine is $25,000. North D~kota is working <br />very agressively to get Mr. Walters of Waltek to relocate in North Dakota by <br />offering to move his operation and key personnel and sell him a facility for <br />$1.00. Councilm~mber Cox stated that the City Attorney should contact PCA and <br />request that they give Waltek 30 days to get into oomplianoe; why fine somebody <br />$25,000 that is already cooperating with the Comty and considering expnding <br />and hiring 10 more people. Minnesota's Governor is running all o~er the worlk <br />trying to get more business for Minnesota and at the same time our existing <br />businesses are being chased away. <br /> <br />City Attorr~y Goodrich stated that even though Waltek provides the City with <br />tax base and jobs, it would be inappropriate for the City Attorney to get <br />involved and set a precedent; Mr. Walters should have his c~n attorney review <br />this situation. <br /> <br />August 13, 1985 <br /> <br />Page 18 of 22 <br /> <br /> <br />
