Voting Yes: Mayor Heitman, Councilmmbers Sorteberg, Cox, <br />Reimann and Schlueter. Voting No: None. <br /> <br />~ Reguest For A Tempo_ rary Conditional Use Permit; Case Of Mr, Norm <br /> <br />Mr. Goodrich stated that there is a piece of property at the intersection of <br />County Roads ~116 and ~56, just south of T~m ~u~b, where presently a mining <br />and excavation project is going on. Ramsey has ordinances stating that such an <br />operation requires a conditional use permit; Mr. Norm Holm o~ns the property <br />and he does not have a permit for the operation. Mr. Norm Holm contends that <br />he is a non-conforming use because of previous similar operations on this <br />property. Mr. Goodrich stated that he has verified that similar operations <br />have been carried on at this property prior to 1973; Ramsey tc~n~p had some <br />ordinances in effect relating to this type of activity but it has not been <br />determined whether or not they were properly published. A temporary <br />restraining order has been placed on the operation. Not withstanding all this, <br />Mr. Holm has agreed to apply for a conditional use permit. Mr. Goodrich <br />reviewed the proposed resolution with Council and suggested that Council <br />consider granting Mr. Holm a t~nporary conditional use permit, which does not <br />require a I~3b]_ic hearing, contingent upon Mr. Holm entering into a development <br />agreement requiring that the hours of operation be limited, a grading and <br />restoration plan be provided, certain screening on the north be provided, dust <br />control be maintained (which, to Mr. Holm's credit, is already being done), and <br />an escr~ be provided to insure that screening and restoration will be <br />accomplished. Mr. Goodrich stated that to this point, no citizens have called <br />to complain about the operation but he has noticed s~ne gravel accumulation on <br />Cty. Rd. ~56 which Mr. Holm has agreed to take care of. <br /> <br />Mr. Holm presented a sketch plan for Council review. Mr. Holm stated that' he <br />had assumed the activity was grandfathered in on the p~operty and he would be <br />willing to test it in Court; in the spirit of cooperation he is willing to <br />apply for a t~porary conditional use permit. Mr. Holm stated that he doe~' t <br />believe screening on the north is necessary as there is no ~cd for the <br />operation to get any closer than 200' from the north property line. <br /> <br />Mr. Goodrich stated that the City required a $7500 bond and a $1000 cash <br />deposit to administer the permit in Mr. Bud Sauter's case. <br /> <br />Mr. Holm stated that he is willing to post a bond but does not see the ' <br /> August 13, 1985 <br /> <br />Page 19 of 22 <br /> <br /> <br />
