(m) Preservation of Woodland Areas: <br /> <br />(1) <br /> <br />No clear cutting of woodland areas shall be permitted. Shade <br />trees of six {6) inches or more in caliper shall be saved un- <br />less it can be demonstrated that there is no other way to <br />develop the site. <br /> <br />(n) Preservation of Shoreland, Wetland, and Marsh Areas: <br /> <br />Land and vegetation within one hundred {100} feet of any shore- <br />land or marsh area shall be preserved and not altered in any <br />way, shape, or form except seed or sod. <br /> <br />(o) No landscaping shall be allowed within any utility easements:or road <br /> right-of-way except seed or sod. In a drainage easement, landscaping <br /> may be permitted with the approval of the Zoning Administrator° <br />(p) Implementation of Landscape Plan: <br /> <br />(1) <br /> <br />(a) <br /> <br />Prior to the granting of any building permit, a deposit shall <br />be made to the City, in cash or a Letter of Credit, approved <br />by the City, equal to one hundred fifteen percent {115%) of <br />the estimated cost of all landscaping improvements as indicated <br />on an approved landscape plan. <br /> <br />Purpose: The purpose of this section is to promote a pleasant <br />physical environment and to protect the p.ublic and private property <br />within the City by regulating the location, height, type of con- <br />struction, and maintenance of all fences. <br /> <br />(b) Definitions: <br /> (1) <br /> <br />(c) <br /> <br />(2) <br /> <br />(3) <br /> <br />Permit Required: <br /> <br />(1) <br /> <br />Fence: A fence is defined, for the purpose of this ordinance,~f"'~ <br />as any partition, structure, wall, or gate erected as a divider--~'~'~ <br />marker, barrier or enclosure and located along the boundary, ~'---1 <br />or within the required yard. For the purpose of this section, ~ <br />a fence shall not include naturally growing shrub~, trees <br />or other foliage. <br />A Boundary Fence: A boundary fence is any fence parallel to ~t~-')~ <br />the property line. <br />Privacy Fence: A privacy fence is any fence used for screening ~ <br />of outdoor living areas and for enclosures where restricted <br />visibility or protection is desired. ~ <br /> <br />No fence shall be erected or substantially altered in the <br />Ci~ of Blaine without securing a permit from the Building <br />Inspector. All such pemits shall be issued upon a written <br />application which shall set forth the ~pe of fence to be con- <br />structed, the material to be used, height, and exact location <br />of the fence.
