CO~DITIO~., ~ PER.TS <br /> <br />The purpose of this section is to provide the City of <br />Bamsey with a reasonable degree of discretion in determining the <br />suitability of oertain designated uses upon the general welfare, <br />public health, and safety. A conditional use is a use which <br />because of certain characteristics cannot be properly classified <br />as a permitted use in the zoning district within which it is <br />proposed. Conditional use permits are designed to meet the <br />problem which arises where certain uses, although generally <br />compatible with the basic use classification of a particular <br />zone, should not be permitted to be located as a matter of right <br />in every area included within the zone because of hazards <br />inherent in the use itself or special problems which its proposed <br />location may represent. <br /> <br />Applications for conditional uses shall be filed with the zoning <br />officer and shall be a(x~m~ed by: <br /> a. An application fee in an amount equal to that set by <br /> resolution of the City Council; <br /> b. A site plan and supporting data which shcws the size, <br /> location, and topography of the site, the use of adjacent <br /> land, the proposed site, bulk, use, and location of <br /> buildings, the location and proposed function of all <br /> yards, open spaces, parking areas, loading (where re- <br /> quired), storage areas, screening, fencing, signs, ac- <br /> cessory structures, the location of all utilities, and <br /> the timing of construction proposed. <br /> <br />~he zoning officer shall forward copies of the application to the <br />Planning (k~ission and City Gouncil for review and approval. <br /> <br />The Planning Commission shall conduct a public hearing on the <br />conditional use application and shall give at least 10 days <br />mailed notice to property owners within 350 feet of the outer <br />boundaries of the property in question. Ten days published <br />notice in the official newpaper shall precede the hearing. Any <br />person may appear and testify at the hearing either in person or <br />by duly authorized agent. The Planning Commission shall forward <br />its findings on the application to the City Council within 30 <br />days of the public hearing unless the petitioner agrees in <br />writing to a time extension. <br /> <br />~he City Council shall review the application and findings of the <br />Planning C(x~ission and shall act upon said application within 30 <br />days after receipt from the Planning Commission. If the City <br />Gouncil denies the application, that action shall be the City's <br />final administrative action on the application. <br /> <br />If the City Council approves the application, as a condition of <br />that approval, the Council may attach such conditions as it deems <br />necessary, including the duration of the conditional use permit. <br />Ail development, construction and use, shall be in accordance <br />with the approved plan and conditions required by the City <br /> <br />C-4 <br /> <br /> <br />
