USE <br /> <br />Certain uses, while generally not suitable in a particular <br />district, may, under certain circumstances, be acceptable. When <br />such circumstances exist, a special use permit may be granted. <br />A special use permit differs from a conditional use permit in <br />that a special use permit shall be issued for a certain period of <br />time, with automatic cancellation at the end of the time unless <br />it is renewed, or conditions may be applied to the issuance of <br />the permit and/or periodic review may be required. <br /> <br />Applications for special use permits shall be filed with the <br />zoning officer at least 21 days prior to the application being <br />placed on the Planning ~ommission agenda. The application shall <br />include: <br /> <br />a. An application fee. <br />b. Name and address of the applicant. <br /> <br />c. Ge legal description of the property involved <br /> in the application, including the street address, <br /> <br />d. Name and address of ~ers of the property and <br /> any other persons having a legal interest therein <br /> if different fr~m the applicant. <br />e. A site plan dr~n to scale showing the property <br /> dimensions, grading, landscaping, and location of <br /> utilities, as applicable. <br />f. Ge location of all existing and proposed buildings <br /> and their size. <br />g. Any curb cuts, driveways, access roads, perking <br />spaces, off-street loading areas, and sidewalks. <br />h. ~he special use requested and the reasons for re- <br /> questing it. <br />i. Any other information requested by zoning officer. <br /> <br />The Planning Commission shall conduct a public hearing on the <br />special use application and shall give at least 10 days notice to <br />property owners within 350 feet of the outer boundaries of the <br />property to which the special use relates. Ten days published <br />notice in the official newspaper shall precede the hearing. Any <br />person may appear and testify at the hearing either in person or <br />by duly authorized agent. The Planning Commission shall forward <br />its findings on the application to the City Council within 30 <br />days of the public hearing unless the petitioner agrees in <br />writing to a time extension. <br /> <br />In making a recommendation, the Planning Commission shall adopt <br />written findings of fact detailing the reasons for its <br />recxam~=.ndation. In addition, the City Council shall adopt <br />written findings of fact detailing the reasons for its approval <br />or denial of the application. <br /> <br />In oonsidering applications for special use permits, the Planning <br />Cxm~ission shall consider the following: <br /> a. ~he impact of the use on existing and anticipeted <br /> <br />C-7 <br /> <br /> <br />
