Council. Any development not in accord with the approved plan <br />and conditions shall constitute a violation of this chapter. The <br />conditions imposed shall be imposed only in order to protect the <br />public health, safety, convenience, and welfare or to avoid <br />traffic congestion or hazard, or other dangers, or to promote <br />conformity of a proposed use with the character of the adjoining <br />property and uses, and the district as a whole, or to protect <br />such character. <br /> <br />In approving or disapproving the application, the City Council <br />shall adopt written findings detailing the reasons for its <br />action. <br /> <br />In making the determination of whether or not the conditional use <br />is to be allowed, the City shall consider the following.. <br /> a. ~he nature of the land upon which the use is to be <br /> located; <br /> b. The nature of adjoining land or buildings; <br /> c. The proximity of a similar use; <br /> d. The effect %~x)n traffic into ar~ fr(~ the premises, <br /> or to any adjoining roads; <br /> e. The total number of similar uses within the City; <br /> f. Whether or not the use will be unduly dangerous or otherwise <br /> detrimental to persons residing or working in the <br /> vicinity of the use, or to the public welfare, <br /> g. Whether or not it this use will substantially <br /> adversely impair the use, enjoyment or market value <br /> of any surrounding property. <br /> <br />A conditional use permit shall be approved if and only if it is <br />found to meet all of the following criteria: <br /> a. That the proposed use will be harmonious with and <br /> in accordance with any specific objectives of the <br /> G0mpr ehensive Plan; <br /> b. 5hat the proposed use will be designed, constructed, <br /> operated, and maintained so as to be harmonious and <br /> and appropriate in appearance with the existing or <br /> intended character of the general vicinity and that <br /> such a use will not change the essential character of <br /> that area; <br /> c. That the proposed use will not be hazardous or disturb- <br /> ing to existing or future neighboring uses; <br /> d. That the proposed use will be a substantial imlxov~ment <br /> to property in the i~mediate vicinity and to the com- <br /> munity as a whole; <br /> e. That the proposed use will be served adequately by <br /> essential public facilities and services; such as high- <br /> ways, streets, police and fire protection, drainage <br /> structures, or schools; or that the persons or agencies <br /> responsible for the establishments of the proposed use <br /> shall be able to adequately provide any such service; <br /> f. That the proposed use will not create excessive addi- <br /> tional requirements at public cost for public facili- <br /> ties and services and will not be detrimental to the <br /> <br />C-5 <br /> <br /> <br />
