Lee Johnson Dr, Duane gennen (l~airman Paterson called the regular meeting of the Planning and Zoning Oom%ission to order at 7:36 p.m. Roger Bemanson - 15115 Garnet St. N~ - Stated that on Septimt>er 10, 1984, this Planning O~ssion denied Waste Nanageraent's request for an expansion permit and be feels that this mining permit falls into the same category. fhairman Paterson replied that the (kmmdssipn's action at that time was in regards tm expansion and this request for a mining permit is not an expansion. Oammissioner Dc=per stated that the mining permit is to excavate dirt for cover at the existing landfill. City Attorney (~xxlrich stated that legally speaking, the Oa~ssion, in it's decision making process, must divorce the intended use rrm, the act of extraction. Douglas Fountain - 15255 Carnet St - Stated that this request for a mini~ permit by Waste Mana~mm_nt is essentially another form of a conditional use permit wich will allow r~val of soil from one area to cover waste at the landfill site. Even tboixlh a mining permit will not expand the landfill acreage wise, Naste #anagement will be acootmpIishing what they £equested in ~ of 1984 and %ere 61enied in Septfs~ber of 1984. We will be forced to continue to put up with t~e smell, noise, dust and property c~evaluation as Ieo0gnized by Gouncil ar~ added to their findings of fact on Sel~ct~ber Page 1 of 10
