EX[]]ANGING OF F_A~F~I~N~I~ IN I~I'~ER!S BE~: During the construction of the utilities in the plat of River's Bend, changes in the location of some of the storm drain outlets to the river, as well as the necessity to change some of the drainage easements, became apparent. Accordingly, the actual location of storm drains has been made to facilitate construction. It will be necessary to acquire some easements, where none exist, as well as vacate others where they are no longer needed. Council action in this matter is t~o-fold. ~]e first action will be to merely adopt a resolution allowing Staff to receive the required easements in the plat of River's Bend. The second action is more complex in that the Charter (Section 12.06) requires vacation of public grounds be done by ordinance. ~erefore, it would b necessary to establish a public hearing date and so notify the property owner as well as make publication in the official City newspaper. Itwould be our recommendation that you adopt the resolution allowing us to receive easements in River's Bend as well as set the public hearing date for the vacation of various easements in River's Bend. Enclosure (D2-m) contains the proposed resolution authorizing the Staff to acquire certain easements as well as a list of the easements that will have to be vacated. fbuncfl Action: Your action will be to approve/disapprove of authorizing Staff to receive certain easements in River's Bend and to set a public hearing.
