We hope this letter is <br />viewed as it is submitted; in a positive manner. <br /> <br />Our position in summary i~ the storm sewer project is required to develop <br />Flintwood No. 2, may force development of agricultural land, benefits more than <br />the current assessed parties and does not apportion assessment costs in a fair <br />and equitable manner. <br /> <br />We believe the following points illustrate our position: <br /> <br />This project is not necessary to provide drainage for existing <br />developments but obviously is necessary for the intensly developed PUD's. <br /> <br />The PUD development (Flintwood No. 2) contains a significant amount of <br />marginal lowland and requires drainage structures and controls. <br /> <br />The proposed assessments could force the sale and/or development of <br />agricultural lands against the desires of the owners. <br /> <br />The existing drainage problem in Flintwood No. 1 affects three lots and <br />occurs from significant runoff upstream in the remainder of District 43 <br />during wet weather conditions. However, these upstreaTM areas are not <br />proposed to be assessed. While the affected property owners are <br />concerned, the existing problem is relatively minor compared to the scope <br />of the proposed project and magnitude of the total assessments. <br /> <br />The assessment of one unit for each acre of existing residential to 1.5 <br />units for each acre of PUD cluster home development does not equitably <br />distribute assessment costs when the peak runoff rate is calculated from <br />each type of property (i.e. runoff is directly related to the total <br />impervious area of a parcel). Peak runoff is directly related to capacity <br />required and cost. <br /> <br /> <br />
