I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br />I <br />I <br />I <br />I <br />I <br /> <br /> CITY OF RAMSEY <br /> <br />PROPOSED GRADING AND MINING PERMIT AG~F,F~NT <br /> <br />This contract entered into this day of , 1985, <br />between the City of Ramsey, hereinafter referred to as "City," <br />and Messrs. Bud Suater, Thomas Sauter, and Greg Sauter, <br />hereinafter referred to as "Applicant," in conjuction with a <br />grading and mining permit to mine fill from the property located at <br />the northeast oorner of the intersection of Industry Avenue and <br />Sunfish Lake Boulevard. <br /> <br />The grading and mining permit is hereky granted oontingent upon the <br />Applicant agreeing to and complying with the following <br />conditions: <br /> <br />A phasing plan and restoration plan shall be provided <br />and followed to minimize wind and water erosion of the <br />site and which plan shall not allc~ for more than five <br />acres to be exposed at any one time. Said plan is at- <br />tached hereto and incorporated herein as Exhibit A. <br />Restoration as used herein shall be defined as meaning <br />grading and top soil replacement and grass seeding such <br />that turf is established which will prevent water and <br />wind erosion. <br /> <br />A buffer area shall be 30 feet in width and shall include <br />trees of the density, variety and size to be approved by <br />the City Planner. Such buffer area shall be located <br />between the residential properties to the north and the <br />mining operation. No work shall be oommenced within 500 <br />feet of the north boundary until the buffer area has been <br />established such that the trees planted in the buffer area <br />are six feet in height. <br /> <br />3. All final slopes shall be less than four feet horizontal <br /> to one foot vertical (4:1). <br /> <br />5 <br /> <br />The hours of mining operation shall be limited to the fol- <br />iowing: <br /> a. Monday through Saturday: 7: 00 a.m. to 8: 00 p.m. <br /> <br />The Applicant shall not move the mining and grading <br />operation from one five-acre tract to another without the <br />express written consent by the City Engineer which consent <br />shall be in compliance with the terms and conditions of <br />this agr e~ment. <br /> <br />A bond in the amount of $ 15,000.00 to cover any screening, <br />buffer and turf establishment and costs incurred in the <br />restoration plan shall be filed with the City. <br /> <br /> <br />
