If an <br />Organizatior, member is also an officer of the Organiz0tion, th~ <br />alternate shall not be entitled to serve as such officer. <br /> <br />SECTION Ill <br /> <br />Organization Powers and Duties <br /> <br />3.1 Upon execution of this Agreement by the parties, the Organization <br /> <br />shall have the authority as follows: <br /> <br />Ao <br /> <br />The authority to prepare and adopt a Watershed Management Plan <br />meeting the requirements of M.S. §473.BTB. <br /> <br />The authority to review and approve local water management plans <br />as provided in M.S. §473.B79. <br /> <br />The authority of a Watershed District under Minnesota Statutes, <br />Chapter ll2, to regulate the use and development of the land <br />when one or more of the following conditions exist: <br /> <br />l) <br /> <br />Local government unit exercising planning and zoning <br />authority over land under sections M.S. $366-10, 2366.19, <br />394.21, 394.37, or 462.351 to 462.364, does not have a <br />local water management plan approved and adopted in <br />accordance with the requirements of $473.879 or has not <br />adopted the implementation program described in the plan. <br /> <br />An application to the local government unit for a permit <br />for the use and development of land, required and limited <br />to, a variance from the adopted local water management <br />plan or implementation plan of the local unit. <br /> <br />3) <br /> <br />The local government unit has authorized the Organization <br />to require permits for the use and development of the land. <br /> <br />Other powers necessary to exercise the authority under Clauses A <br />through C including the power to enter into contracts for the <br />performance of functions with governmental units or persons. <br /> <br />3.2 E__mployment' The Organization-may contract for services, may <br /> <br />utilize existing staff of the parties, and may employ such other persons <br /> <br />as it deems necessary. Where staff services of the party are utilized, <br /> <br />such services shall not reduce the financial con~nitment of such party to <br /> <br />the operating fund of the Organization unless the Organization so <br /> <br />authorizes, where the utilization of staff services is substantial. <br /> <br />-4- <br /> <br /> <br />
