We will comment on the shoreland and critical area sections <br />separately. <br /> <br />Shoreland <br /> <br />Based on our review, the draft ordinance has been found to be in <br />substantial compliance with the "Minimum Statewide Standards and <br />Criteria for the Management of Municipal Shoreland Areas of <br />Minnesota" (Minn. Regs. NR82-84). In accordance with Minnesota <br />Statutes S 105.485, Subd. 6, I hereby certify state approval of <br />Ramsey's shoreland management controls contained in the draft <br />Ordinance #85-2. <br /> <br />Mississippi River Critical Area <br /> <br />From our review of Ramsey's Critical Area Section, we conclude <br />that the ordinance meets or exceeds the minimum standards and <br />intent of the program with the exception of Section 170.0112G-3(a). <br />The notification procedure for the Critical Area is different <br />than the Municipal Shoreland Ordinance standards because the <br />Commissioner of Natural Resources must also certify certain actions <br />(i.e., variances, conditional uses, inconsistent plats and ordi- <br />nance amendments). The Critical Area procedures are [he same as <br />in your Wild and Scenic River Ordinance 81-4. To be compliant, <br />Ordinance 85-2 must contain a section similar to Section 170.0711.7 <br />of your Ordinance 81-4. Also, your ordinance must include a state- <br />ment that provides for a copy of all plats to be submitted to the <br />DNR within ten (10) days of final action.
