Ramsey, Minnesota 55303 Dear Mayor Heitman: APPROVAL OF RAMSEY'S SHORELAND & CRZTICAL AREA MANAGEMENT CONTROLS The Department of Natural Resources (DNR) has reviewed the final draft "City of Ramsey Ordinance #85-2, Environmental Protection" which was submitted by City Engineer Pete Raatikka on March 13, 1985. We will comment on the shoreland and critical area sections separately. Shoreland Based on our review, the draft ordinance has been found to be in substantial compliance with the "Minimum Statewide Standards and Criteria for the Management of Municipal Shoreland Areas of Minnesota" (Minn. Regs. NR82-84). In accordance with Minnesota Statutes S 105.485, Subd. 6, I hereby certify state approval of Ramsey's shoreland management controls contained in the draft Ordinance #85-2. Mississippi River Critical Area From our review of Ramsey's Critical Area Section, we conclude that the ordinance meets or exceeds the minimum standards and intent of the program with the exception of Section 170.0112G-3(a). The notification procedure for the Critical Area is different than the Municipal Shoreland Ordinance standards because the Commissioner of Natural Resources must also certify certain actions (i.e., variances, conditional uses, inconsistent plats and ordi- nance amendments). The Critical Area procedures are [he same as in your Wild and Scenic River Ordinance 81-4. To be compliant, Ordinance 85-2 must contain a section similar to Section 170.0711.7 of your Ordinance 81-4. Also, your ordinance must include a state- ment that provides for a copy of all plats to be submitted to the DNR within ten (10) days of final action.
