certificate signed by an officer of the Association setting <br />forth whether the assessments on a specified Lot have been <br />paid. A properly executed certificate of the Association as <br />to the status of assessments on a lot is binding upon the <br />Association as of its issuances. <br /> <br /> Section 6.8 Procedures for Fixing Assessments. The <br />Association shall fix the date of commencement and the <br />amount of the assessment of each Lot for each assessment <br />period, and give written notice of the amounts and dates to <br />the respective Owners thereof, at least Fifteen (15) days <br />tn advance of such period, and shall prepare a roll of the <br />Lots and assessments applicable thereto, which shall be <br />kept In the office of the Association and shall be open to <br />Inspection by Owner. The Association shall, upon demand of <br />any Owner, mortgagee, title company or realtor involved in <br />the sale of such Owner's Lot and for a reasonable <br />administrative fee, Furnish to such person a certificate in <br />writing signed by an officer of the Association setting <br />Forth any unpaid assessments and related fees anO costs <br />against such Owner's Lot. Such certificate shall be <br />conclusive evidence of payment or non-payment of any <br />assessment relating to the Lot in question. Such <br />certificate shall be conclusive evidence of payment of any <br />assessments therein stated to have been paid. <br /> <br />Section 6.9 Non-Payment of Assessmentsl Liens~ <br /> <br />Remedies. <br /> <br /> a. Assessments are a personal obligation of each <br />Owner of the assessed Lot. If the assessments are not <br />paid on the due date as specified in Section 6.?, then <br />such assessments shall be delinquent and shall, <br />together with administrative charges for late payment, <br />such Interest thereon and costs of collection, as <br />hereinafter provided, become a continuing lien on the <br />Lot which shall bind the Lot i~ the hands of the Owner, <br />his or her transferees, heirs, devisees, personal <br />representatives and assigns. The personal obligation of <br />the Owner to pay such assessment and related costs <br />shall remain his or her personal obligation and that of <br />any of his or her heirs or personal representatives. <br /> <br /> b. I¢ the assessment is not paid on or before the <br />due date, the Association may impose interest from the <br />due date at the highest rate allowed by law, and/or <br />bring an action at law against the Owner personally <br />obligated to pay the same or foreclose the lien by suit <br />in the manner provided for foreclosure of mortgage <br />liens, Each Owner, by acceptance of any conveyance of <br />any Interest in the Property, grants to the Association <br />a power of sale to accomplish the foreclosure and sale <br />of such Owner's Lot. In such actions the Association <br />shall be entitled to recover, in addition to the <br /> <br />Northfork <br /> <br />page 12 of 25 <br /> <br /> <br />
