I I (iv) Grantin9 a cond~tiona! use permit for private oz oomme~cia! recreational develop- (b) Oertification Prooess I (i) A copy of all notices of any public hearings, or where a public hearing is not required, a copy of the application I to consider zoning amendments, variances, or inconsistent plats under local ordi- nance shall be sent so as to be received i by the Commissioner at least thirty (30) days prior to such hearings or meetings to consider such actions. The notice of ap- plication shall include a copy of the pro- I posed ordinances or amendment, or a copy of the proposed inconsistent plat, or a descrip- tion of the requested variance, or a copy of i the oonditional use permit application, where applicable. I I (ii) Ramsey shall notify the Commissioner of its final decision on the proposed action within ten (10) days of the decision. (iii) The action becomes effective when and only when either: (a) The final decision taken by Ramsey has previously received certifica- tion of approval from the Commis- sio~er, or (b) Ramsey received certification of approval after its final decision, or (c) ~hirty (3) days have elapsed from the Commissioner received notice of the final decision, and Ramsey has re- ceived from the Commissioner neither certification of approval nor notice of non-approval, or (d) The Commissioner certifies his approval within thirty (30) days after conducting a public hearing. (iv) In the case the Commissioner gives notice of non-approval of an ordinance, variance, or inconsistent plat, either the applicant or the City Administrator may, - 35 -
