Chairperson Nixt introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #04-06-139 <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT #0677 RELATING TO A REQUEST FOR <br />A VARIANCE FROM LOT WIDTH REQUIREMENTS <br /> <br /> WHEREAS, Fred and Rose Kalk, hereinafter referred to as "Applicant", have properly <br />applied for a Board of Adjustment Variance from the minimum lot width requirement established in <br />Section 9.20.11 of the Ramsey City Code in order to construct a dwelling on the following legally <br />described property: <br /> <br />The east half of the west 240 feet of the east 415 feet of the south half of the south half of <br />the north three quarters of the northwest quarter of the northwest quarter of Section 22, <br />Township 32, Range 25, Anoka County, Minnesota. <br /> <br />("Subject Property") <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF <br />THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Board of Adjustment for a public hearing pursuant to <br />Section 9.03.05 of the Ramsey City Code on June 3, 2004, and that said public hearing was <br />properly advertised and that the minutes of said public hearing are hereby incorporated as part of <br />these findings by reference. <br /> <br />2. That the Subject Property is an existing lot of record and is considered lawful non-conforming. <br /> <br />3. That the Subject Property is approximately 0.6 acre in size. <br /> <br />4. That the Subject Property is zoned R-1 Residential and is located within the Rural Developing <br /> District. <br /> <br />5. The Subject Property is surrounded by properties that are zoned R-1 Residential ~ Rural <br /> Developing. <br /> <br />6. That Section 9.20.11 states that the minimum lot width in the R-1 Residential - Rural Developing <br /> District is 200 feet. <br /> <br />7. That the Applicant is proposing to construct a new residential dwelling on the Subject Properly. <br /> <br />8. That the Subject Property measures 120 feet adjacent to the public street (156th Ave NW) and 120 <br /> feet at the 40-foot fi'ont yard building setback line. <br /> <br />That Section 9.02 of Ramsey City Code defines lot width as the uniform width measured at the <br />property line abutting the street at the minimum building setback line of the underlying zoning <br />district. <br /> <br /> <br />
