I <br /> <br />I <br />I <br /> <br />FINDINGS OF FACT 00 <br /> <br />1) That in Nov~ber, 1984, Waste Manage~rent of Minnesota, Inc. applied to the <br />City of Rawsey for a temporary conditional use permit to mine and excavate in <br />the following described property in the City of Ra~sey, to wit: <br /> <br />The S-1/2 of the NE-l/4 of Section 27, Township 32, Range 25, <br />Anoka County, Mirunesota <br /> <br />2) That on December 4, 1984, the City's Planning and Zoning Commission, by <br />consensus, recommended several conditions to the Council which should be <br />required of the applicant in the event the Council approves the permit, the <br />minutes of which meeting are incorporated herein. <br /> <br />3) That on February 12, 1985, the City Council conducted a public hearing on <br />the Nov~ber, 1984 application, the minutes of which meeting are incorporated <br />herein. <br /> <br />4) That on February 12, 1985, the City Council denied the permit based on the <br />fact that the develol~ent moratoriu~ as presented by M.S.A. Section 473.806 was <br />still in place as relates to the subject property. <br /> <br />5) That in August, 1985, Anoka County lifted the develot~rent moratorium, with <br />certain restrictions, which action was also followed by the Metropolitan <br />Council in September, 1985. <br /> <br />6) That at this time, Nov~rber 12, 1985, Waste Management of Minnesota, Inc. <br />is requesting a temporary conditional use permit from the City in order to <br />excavate and mine up to 250,000 cubic yards on the subject property. <br /> <br />I 7) That the amount of earth to be mined as requested by the applicant does not <br /> require an Enviror~ental Assessment Worksheet as regulated by the Minnesota <br /> Environwen~ity Board. ,~ <br /> <br />i <br />I <br />I <br />I <br /> <br />10) <br /> <br />13) <br /> <br />14) <br /> <br />15) <br /> <br /> <br />
