I <br />I <br />I <br />I <br />I <br />I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br />This contzact entered into this day of .... , 1985, <br />between the City of Ramsay, hereinafter referred to as "City," and Mr. Allen <br />Sorteberg, hereinafter referred to as "Applicant," in conjunction with plat <br />approval of Sorteberg's 4th Addition. <br /> <br />The plat of Sorteberg's 4th Addition is hereby granted approval with variances <br />to the soil boring and topography requir~ents contingent upon the Applicant <br />agreeing to and oo~plying with the following conditions: <br /> <br /> 1. The approval of Sorteberg's 4th Addition shall apply to that property <br />legally described as follows: <br /> <br />Outlot B, and that part of Outlot A, SORTEBERG'S 3RD ADDITION, <br />according to the recorded plat thereof, lying easterly of the <br />following described line: <br /> <br />Beginning at the southwest corner of said Outlot A; thence northerly <br />along the west line of said Out_lot A a distance of 20.00 feet; thence <br />easterly, parallel with the south line of said Outlot A, a distance of <br />19.03 feet; thence northerly, parallel with the east line of said <br />Outlot A, a distance of 459.96 feet; thence easterly, parallel with <br />the north line of said Outlot A, a distance of 133.00 feet; thence <br />northerly, parallel with said east line, a distance of 432.50 feet to <br />the north line of said Outlot A and said line there terminating. <br /> <br /> 2. The Applicant shall be responsible for the construction of public <br />improv~ents as shown on the final plat, including streets, and drainage <br />eas~rents and ponding areas as required by the City ~gineer. The Applicant <br />shall be responsible for any expense associated with the construction of these <br />iwprov~ents. The Applicant shall guarantee the construction of 158th Avenue <br />N.W. including all necessary ditches, backsloping, drainage and other <br />iwprov~ents in accordance with the specifications of the City Engineer, as <br />specified in the City Code. Pursuant to this guarantee, the Applicant shall <br />post security in the a~ount of $ 36,500.00 which represents 125% of the <br />estimated cost of oonstructing the iwprove~ents as determined by the City <br />Engineer. Said improv~ents shall be completed on or before September 1, <br />1986. <br /> <br /> 3. The Applicant shall restore all disturbed areas on the site as <br />specified by the City Engineer. <br /> <br /> 4. The Applicant shall dedicate the right of way easement of 158th <br />Avenue N.W. to the City. <br /> <br /> 5. This develo~ent agreement shall be recorded as a part of the <br />Appl icant ' s deed. <br /> <br /> <br />
