That the Applicant requested a variance to construct an accessory structure larger than allowed by City Code. 2. That the City Council oonducted a public bearing on this request on July 23, 1985, and that the ~rinutes of said p~blic hearing are hereby incorporated by referenoe as p~rt of these findings. 3. ~hat the City Gouncil denied this request at a ~eeting on July 23, 1985 and that the ~inutes of said ~reeting are hereby inoorporated by reference as part of these findings. 4. That, at a ~eeting on August 27, 1985, the Applicant requested the City Council to reconsider their decision ~ade on July 23, 1985. 5. That the Applicant stated that similar requests had been approved in his neighborhood. 6. That the Applicant stated that be would be willing to request a variance for an accessory structure of 1,000 square feet rather than the initial request of 1,280 square feet. 7. That the City Council tabled the Applicant's request of August 27, 1985 until the City Council can establish a policy regarding the size restrictions on accessory structures. 8. That the City Council introduced Ordinance $85-13 regarding size restrictions of accessory structures on October 22, 1985. 9. That the Applicant's request to construct a 1,000 square foot accessory structure appears to be oonsistent with the proposed amendment to the City Code regulating the size of accessory structures. 10. That the Applicant has stated that the proposed accessory structure would co~ply with the require~rents set forth by the City S~_ff and Uniform Building Code. 11. That the Applicant has stated that he would agree to enter into a develo~ent agreement with the City of R~rsey guaranteeing the conditions of the construction of the proposed accessory structure. The ~otion to adopt the foregoing findings of fact was duly seconded by Council~rber and upon vote being taken thereon, the following voted in favor thereof: and the following voted against 'the sa~e: whereupon said findings of fact were declared duly passed and adopted by the Rawsey City Council this the day of , 1985.
