Issue 4: When Issue 3 (above) was pointed out to the Board, the Board created a new <br /> Document called "Association Rules and Regulations" and posted it for the very first time on our <br /> website on November 8, 2016. Again, how could the Board state they amended this document in <br /> 2012 when this document had never existed until November 8, 2016. <br /> Issue 5: Realtors who have sold homes here in our community, have confirmed they have <br /> NOT seen this Governing Document called "Association Rules and Regulations". When Realtors <br /> sell a home in a Homeowners Association they are required by law to give the new homeowner <br /> all Governing Documents. This would include "Association Rules and Regulations" if they <br /> existed. Many new homeowners in our community have also confirmed they never received <br /> "Association Rules and Regulations"when they purchased their home here in Northfork. <br /> Issue 6: NO BOARD MINUTES EXIST for this Board Meeting on June 12, 2012 that the <br /> Board states they promulgated this rule that Chickens were NOT allowed on properties in <br /> Northfork. Our website does not show any Board Minutes for this meeting, and we have <br /> requested specifically those Board Minutes from the June 12, 2012 board meeting multiple times <br /> from both the Board and Mark Berglund (the HOA's Attorney) without any response regarding <br /> these specific Board minutes. <br /> Issue 7: Board Minutes are a requirement of our bylaws. The Board not taking Board <br /> Minutes at every Board Meeting is clearly a violation of our bylaws. We have requested multiple <br /> times that the Board provide us all Board minutes missing from the website. To date, we have <br /> received NO response regarding our request for Board Minutes missing. This leads us to believe, <br /> the Board has violated our bylaws by NOT taking Board Minutes at all of the Board meetings. <br /> The Board assesses hefty fines to homeowners who are in violation of their Covenants (ie. <br /> Parking a trailer on their driveway, having a boat parked on their driveway for more than 7 days, <br /> etc). It appears however, the Board can violate our Bylaws without being fined, or without any <br /> ramifications. <br /> Issue 8: There has been several families -in our corninunity that have had chickens. The <br /> reason several families have had chickens is because the Board NEVER posted ANYTHING <br /> about"NO CHICKENS IN NORTHFORK"until October 2016, when they splashed a banner on <br /> the front page of our website stating "Livestock is NOT permitted within Northfork HOA". If the <br /> Board promulgated this rule on June 12, 2012, why did it take until October of 2016 to post a <br /> banner on our website regarding this? Had our community been informed of"their" rule they say <br /> they promulgated in 2012, these several families would not have had chickens. <br /> Issue 9: In Mark Berglund's (HOA's attorney) letter dated November 23, 2016, he states <br /> "the Board took the unusual step, which is not necessary tinder the Governing Documents, and <br /> mailed out a voting ballot to the Members seeking opinion regarding the housing and keeping of <br /> chickens on property within Northfork. " Why does our Board believe seeking the opinion of <br /> their Members is considered an"unusual step"? Why didn't the Board seek the Members opinion <br /> FIRST (back in 2012)? It is more "unusual" for the Board to promulgate rules regarding pets we <br /> can not have WITHOUT seeking the opinions of their 270 members. The Board's viewpoint <br /> regarding seeking their Members' opinion as "unusual" states that the five Board of Directors <br /> believe their opinions and viewpoints are more important than the 270 Members who OWN <br /> 31 Page <br />
